On December 19, 2014 Midland National Life Insurance Company has exercised their right to remain silent and abandoned their long standing denial of threatening women to cover up their criminal acts. When faced with overwhelming evidence of state and federal crimes they, in effect, exercised their rights under the Fifth Amendment of the United States Constitution.

Despite being given the opportunity to clarify their position Midland National Life has chosen to maintain their silence.

Midland National Life’s new position is a significant departure from a previous sworn statement by Robert TeKolste President Shared Services at Midland National Life Insurance Company in which he declared

“Contrary to Eric Castaneira's repeated statements on the internet, in blast emails, and to this Court, Midland has repeatedly advised Mr. Castaneira in writing that there is no basis for his intentionally false assertions that the company poses a threat of physical harm to Mr. Castaneira, his friends, or his family.”

However, when confronted with the results of an investigation by a former prosecutor and the specific evidence of dates, license plates, and motive neither Mr. TeKolste nor Midland National Life are willing to make any further statements. Midland National Life has also opposed a hearing before a federal judge to address the allegations and evidence. It’s not hard to understand why. A violation of 18 U.S. Code § 1512 carries an imprisonment of up to 20 years for any employee or agent of Midland National Life that participated in this crime.

Attorneys for Midland National Life admitted in a 2010 court filing that the threat of intimidation or violence is a violation of 18 U.S. Code Chapter 96 - RACKETEER INFLUENCED AND CORRUPT ORGANIZATIONS (RICO), which is used to prosecute organized criminal enterprises. Midland National Life has faced RICO allegations in federal court before.
