I published and sell ebooks directly through the Amazon Kindle marketplace utilizing DTP (Data Text Platform). Recently, I retired several old editions of my ebooks, replacing them with new and revised editions with updated covers. As of this date I have also seen sales of the old editions which were not even republished. Further, the new covers now appear on the old books. This in essence creates a conflict between the sales of the updated versions of the books and the old ones, and therefore constitutes a restraint of trade issue between me and DTP, and despite all attempts to resolve the issue DTP has refused to fix the problem. Recently I have read many blogs from other publisher who are having the same problem, and also issues with its seller agreement, which outlines Amazon's "rights" but gives no consideration to the publishers involved. Even Simon & Schuster, a prominent publisher, has opted out of Amazon's Kindle program. But DTP and Amazon remain immovable. Is there a legal recourse, or is another class action suit necessary?
