thank you for destroying my life. For 2 months i've been having problems with online banking pulling funds from the wrong account. i've been trying to stop this . i call every two weeks when this happen and a representative walks me through step by step and tells me the problem has beeen solved and this wont occur again. two weeks later this occurs again and i start the process over again. the rpresentatives dont take notes for the next time when i call so it causes more problems and they are not aware that this has been going on sometime but i beleive the representatives are trained to make the customers fell like they are at fault. up to today this problem has caused major major problems. i have direct deposit and it is almost taking my check every two weeks. bills are not being paid water turned off and etc. since Dec this has cost me (including my pay check )around $2000 and counting. my purpose of opening my new account and start using online bill bay was to manage my money better, watch what im spending and to keep track of my money being the way the economy is. Big mistake. Bank of america made my life a living hell. i would tell everyone to run far from this bank. the worse. I've contacted BBB and i may contact other local television to tell the people in georgia beware of whats going on. the online bill pay is to confusing and ruined my life. Now i know when someone at bank of america read this letter. no actions will be taking and thats fine because they probably get letters like this frequently but if this will stop them from doing to other people what they done to me then that good enough for me. and if you can sleep at night after treating people this way then God be with you.

Secret life insurance policies on employees
A Texas law firm is investigating Citigroup and other banks for taking out secret life insurance policies on current and former employees, and collecting the benefits when they die.

HOUSTON, Jan 13, 2009 (BUSINESS WIRE)-- Attorneys from Houston's The Clearman Law Firm ( www.clearmanlaw.com ) are announcing a nationwide investigation of banks that have purchased secret life insurance policies in order to collect benefits when current and former employees die.
Many of the world's largest banks have purchased "bank-owned life insurance" or "BOLI" for years, including Bank of America, JP Morgan Chase, Bear Stearns, Citigroup, Wachovia, Washington Mutual, Wells Fargo and many others.
"We are investigating banks that insure the lives of employees without their knowledge or consent, " says class-action attorney Scott Clearman of The Clearman Law Firm. "These types of policies benefit only the banks, not their employees."
In a BOLI program, a bank designates itself as the beneficiary of life insurance policies covering its employees. Nearly half of all U.S. banks have reported owning BOLI policies at an estimated value of $120 billion.
A bank purchasing a BOLI policy must provide the insurer with personal information belonging to each covered employee, including his or her name, sex, age and Social Security number. Employees' Social Security numbers are then used to conduct "death sweeps" where banks typically hire outside brokers to sweep public records in order to learn if an employee or former employee has died.
A person whose life a bank insured without consent may have a right to sue for the bank's misappropriation of their identity (name, sex, age and Social Security number). Employees may be able to recover profits made by the bank, broker and insurer.
"It is ironic that thousands of bank employees have been laid off, and yet the banks still stand to benefit financially when those employees die, " says Mr. Clearman.
Since the early 1990s, Mr. Clearman has been a pioneer in class-action lawsuits against employers for wrongfully insuring employees' lives for the employers' benefit. Following several individual lawsuits for the families of deceased employees, Mr. Clearman pursued landmark class-action claims against Wal-Mart and Fina that resulted in major settlements for his clients.

Overcharged
Bank of America charges me overdraft fees on pending charges in my account...even though I had plenty of funds in my account to cover the withdrawals. When I contacted 'Customer Service' they explained that the fees were legal based on their policies. So, if you put it in writing that you are going to take advantage of someone...it's okay?
B of A went on to explain that there were authorized charges being held against my account, which is why these charges were legitimate. When I asked why I couldn't see those authorized charges prior to them being accessed they explained they have a system problem that doesn't allow you to see these fees. Isn't that convenient.
Bottom line is that my account was never OD...B of A even admitted this to me. According to them this is a timing issue. They 'held' authorized charges that were going to be posting to my account prior to me making a deposit--even though they were both on the same day. I knew these charges would be coming out which is why I deposited money...duh. I'm not an idiot and I know how a checking account works. I'm an educated individual with a good job and I don't appreciate being taken advantage of. Apparently B of A didn't get enough of our money from the TARP and now need to invent ways to overdraw peoples accounts in order to get additional income.
Bottom line is that B of A is unethical in this practice. Not that anyone at B of A cares, but I will be closing my bank account. I'm just a lowely working fool who doesn't mean crap to B of A however I refuse to let this type of mismanaged, financial giant take advantage of me any longer. In addition, I will be filing a complaint with the banking regulators as well as my elected officials. The $70 I was charged isn't the issue to me at this point, its the fact that this type of unethical behavior is practiced. At some point someone will have to take all the individual claims against B of A seriously and hopefully will do something about it.
Word of warning...don't bank with Bank of America.

overdraft fees
I have a checking account with this bank and sometimes have a small balance before my paycheck is automatically deposited. This week, I was charges an overdraft fee of $35.00 for a $6.38 check card transaction even though my balance was more than the transaction. Another check was coming through their system at the same time as the $6.38. Rather than pay the $6.38, they took the larger amount knowing full well that by doing this, both transactions would bounce. I contacted the bank via internet and the lady said that "they had found that their customers would prefer the larger items to clear first". This is absolute crap and not a policy. It is merely what "they have discovered". THIS BANK WILL RIP YOU OFF! DO NOT BANK WITH THEM! THEY ARE THE WORST BANK EVER!

credit card interest
They say that my wife was late on a payment, we have proof that we paid it on time, yet our interest went from 9.9 % to 22 %, payment from $203.00 to over $600.00 we have always paid our credit cards on time. See how the Bank of America treats people, Everyone stuggling to do whats right, They got there money from our Gov. now what.

Stop Fee
I requested a st0p payment a few days ago thinking that it would be better for me have the check destroyed and stop the payment of the check just in case someone found the check and tried to order something online. I checked my account yesterday and found that I was charged $28 to stop payment on a check. If I would have known that there was going to be a fee, then I never would have proceeded. I did this online and I was never prompted that there would be any fee. However they informed me that in the little print (8.5 font) that it mentions that a fee could be charged. I'll be damned they were right. I tried to explain to their customer service department 3 different times, 3 different people and they all told me that the could reverse the stop payment, but they could not reverse the fee. Bank of America has the worst customer service that I have ever experienced with a bank. I guess if you want to be able to have banks all over the country, you have to pay for it by crappy customer service and fees that they don't tell you about until it's too late, or in my case they hide it in the smallest font possible and when you dispute it they just send you on your way. AHHH!!! I just needed to vent and share my experience. Needless to say, I will no longer bank with them.

Overcharged
I sold my car in Sep 3 Saturday for $9000 cash, Since I needed the money in my account ASAP, I couldn't wait until Monday and went to a Bank of America ATM after 30 minutes I made the sell and made an ATM deposit for $9000 cash (It was mostly $100 bills, maybe some $50 bills). I received my receipt. Sep 6 the money was in money account fully available. I used $3000 of it and put the rest into my savings account. After two weeks Sep 21, the bank took the $9000 from my account with the reason of Envelope not found. I called the bank and they started an investigation and they said it can take about 2 or 3 weeks to investigate the problem and they refused to put the money back until the investigation is over. Right now, my major account is in -$8700, unusable, all bill payments is tied to that account, automatic payments and also my paycheck goes to that account. I need to make a lot of changes. I trusted the bank to make this large ATM Deposit, not a second I didn't think there would be a problem. Now I will never make ATM Deposits ever.

Terrible bank
The software application that is provided by Bank of America for downloading to cell phones that allows access to account balances, presents the account data in a manner that is misleading when compared to the same data available through their On-Line Banking function when viewed by computer. The misleading data generates a revenue stream from the overdraft charges it creates.
When contacted about the misleading information their Executive Customer Service representative rudely made it clear that Bank Of America does not accept information regarding the accuracy or functionality of their On-Line applications from their customers. He also rudely made it clear that Bank of America is in business for making a profit and that I should be using pencil and paper for tracking my account data instead of trusting the accuracy of their On-Line applications.

Overcharged
I have automatic payments set up for my Bank of America (BOA) credit card set to pay a certain amount on the day I receive my e-statement. BOA is claiming that one of the payments was never made because my bank told them the account was closed. The bank account was never closed and none of the other automatic payments have been late or missing or declined by the bank. They were unhelpful on the phone. They told me to take it up with my bank. So I checked into it and of course the bank has no idea why BOA would make such a claim. And of course BOA is charging a higher interest on the supposed missing payment. Grrr...

Holding our funds
BE VERY CAREFUL - THEY HOLD YOUR FUNDS -We are a non-profit business. One of our checks came in and was returned. We still had a positive balance on our accounts. However, after 7 years and no warning, BOA froze ALL our accounts on December 23rd at 8pm. No warning, no nothing. Our money has been unable to be accessed for 8 days so far. Supposedly, "corporate has decided that we are a high risk customer" and is closing our accounts on December 31 (today) We are going to be mailed Cashier's checks from each account today - supposedly.
Our non-profit business serves the youth. I am not sure how to publicize this event but I want everyone who has an account with Bank of America to switch. They will pull your accounts at a moment's notice without telling you, no matter how long you have been with them or how much money you pass through them. We are small but still passed over $750, 000 through them this year. There is no one local to talk to. The branches are at the mercy of "Corporate" and can't help you. I have opened a new account at TD BankNorth and it is nice to talk to humans who actually know you and actually want your business. What was amazing to me is that they closed my wife's and mine personal accounts also!! They have frozen them since December 23rd despite having positive balances!! Fortunately we have other means of buying food, gas, etc. but had we not we would have had a terrible holiday season!
If you own a local business do not bank with Bank of America. They do not care about you and their local branches are completely powerless. Go with someone you can have a personal relationship with.
