Overcharged
I have been a customer with Bank of America since the first time I ever opened a banking account. I have had several issues over the years regarding banking fee's some that were my fault and others that weren't.

I recently had an issue with the bank because one day I was prompted to change my login name & password when I went to get to my online banking. Ever since that day I was having issues when I tried to login where a screen would come up telling me that either my user or password was incorrect which they were not. One night I had made several transactions knowing that there weren't enough funds in my one checking account and that before the deadline I would need to transfer funds in order to avoid any overdraft fees.

Well, when I tried to login to my account that night I received the same error of having an incorrect user name and/or password when I didn't. I tried to login several times that night to no avail. I knew I was going to have a problem so I made sure 1st thing that morning to contact a rep and make them aware of the issue as well as go ahead and transfer the funds I needed to. To make an extremely long and excruciating story short, I received the run around when I contacted customer support. The first rep tried to give excuses like that I shouldn't have used my card if I knew money wasn't in the account and such. Her manager told me he wouldn't give a refund because he couldn't verify that an error had been made by the bank but that if I could in fact verify that an error had been made that he would give a refund. I then spoke with a rep from tech support who verified the error but had been told to still give no refund.

Ok, so I took my evidence and argument to my local banking center and spoke with the VP there. After a long struggle with his superior he refunded 2 of 3 fees that had been charged (bear in mind each fee is $35 and aside from the 3 fees that had posted, 2 transactions were still in pending so those fees didn't hit till later that week.) The bank did this because they could recognize their error but still refused to give me a FULL refund because of it. So, when the 2 other fees hit my account I went back to the same VP (Very nice guy) who pleaded just about (I heard him) with some banking individuals over the phone urging that those fees needed to be refunded as well. They refused!!

Get this... I understand that when you screw up with your banking it is your fault, however, and this isn't the first time this has happened to me, but when fees hit because of a banking error the bank states they will refund them. They are full of it though!! The issue I had was a bank error and was confirmed to be a bank error by several of the banking staff. Regardless they acted as though some blame should be put on my part and therefore would only give a partial refund so my original BS fees totaling $175 was reduced to a whopping $105. So I was pretty much charged $105 because I was unable to login to my account to cover my ass. How do you like that?!?!?! Even when you are aware of what you need to do to keep from getting his with fees the bank always finds a way to screw you over. Even the VP at the banking center I went to said that it was crap and that he wished he could do something but he just didn't have that kind of authority. He said that the individuals who do have that authority (the millionaires taking my hard earned cash) should have to handle customer service complaints because it really was hard for this guy on a regular basis to pretty much have to tell banking customers that yeah even though this is the banks fault we have the ability to ruin your credit and steal your money and there isn't anything you can do about it.

The bank is one big LIAR. If they say they will give a refund for fees that hit your account due to a bank error then they should. Not give a partial refund and say screw you and HAHA under their breath. As an individual this really hits hard. I live paycheck to paycheck and recently had a baby (now 2 months). I of course never qualified for WIC so even though I am struggling because of the economy I still get no help with having to provide for my son. Now I have to pay the bank $105 to avoid getting a bad rap on my credit report for fees that were caused because of their own error.

This is really unfair. I know I shouldn't have these fees and they know I shouldn't but they are the ones with the power. How F'ed up is that?!?! Someone really needs to take down this corporation and I would love to be the one to do it. You know why?!?! So I can take the money that the bank has stolen from me and many others and use it to start a bank that works for the people. It isn't fair that some jerk gets to sit in his expensive home living off my hard earned cash and others just like me.

I am not a member of Bank of America so I can fork over my cash to them to spend, but so I can responsibly pay my bills and use that cash for the well being of my child. I am really tired of people who like me are getting ripped off for faults that are not there own. Is this the America our founders envisioned? Did they really set up this country so the big man can take more money from the little man.

If you have ever been in my shoes so to speak, then please reply to this report with your own stories of how the bank still charged you fees even after admitting to the fact that those fees were due to a bank error. I believe that if enough people get together with enough substantial evidence that they were charged fees due to a Bank's error that together we can take this monster of a bank down.

As a community we have to say enough is enough and rally together to do something about it. I am confident that if we can then a lawyer will have enough evidence to take this thing to court and fight it. It will be a big gain for our working class community all around this country. And once we've taken down the big guys we can get together and build up a new banking system to change the way things work so that they are fair and just, just as our founding fathers wanted this country to be.

Overdraft fees
Bank of America's overdraft fees are completely deceiving and unfair. $35 dollar charges for spending ONE dollar more than I have when the bank displays your information making it appear as if I actually DO have the money is just EVIL.

Overcharged
Third time this year BofA doubled my interest rate on cards I own. This one is the kicker though. Went from 14.9% @ $187.00 min payment to 27.99% @ $291.00 min payment in one billing cycle. Asked why. Response was because I did not opt out on the 'letter' I received in July.

I didn't get any stinking 'letter'! No late payments, great credit score (over 700) and bam! This should not be legal in this country! I will definately be interested in getting in on a class action suit against these loansharks. Am in the process of trying to negotiate my original interest rate with no success. Keep being put on hold and/ or transfered to someone else (phone tag) every time I call.

holding up my money
BOA have decided to close my checking / Saving acct. on Nov.5 and at the same time my acct. have an available credit of $301. dollars in checking and $125. in Saving, BOA Risk dept. went in and post my acct. both checking / savings to a $ -888867.00 Balance that I owe BOA and cause my bill pay online post on the same day in the amount of $275 cleared, but Nov. 6 BOA returned this payment and charge me $25 for NSF..but credit back to my acct. after phone conversation with the BOA Rep. Now BOA decided not to release any fund which is my own money that I need until the end of NOV. BOA of have no rights to hold up my money without paying me any interest til NOV. 24 .
With this mess that BOA cause my Credit Card bill to be Late and heard my credit and being charge with late fee. Before I take further step..I expect BOA to return my money ASAP and contact me immediately. After hours conversation with BOA Risk dept. Reference to a $ -888867.00 balance they decided to remove it from my acct. and post my funds back . I feel that i been miss treated badly and the people of BOA just don't care.

Awful bank
My daughter, who is a senior at UMass Dartmouth in Dartmouth Massachusetts, works part-time at the school. She received a small paycheck for $60.00 recently and went to cash it at a Bank of America because the check was written from the University's account at Bank of America. My daughter does not have an account anywhere near the school. Bank of America charged her $6.00 to cash that check... even though it was written from their bank. I think this is lousy. I called them to check whether they in fact do this as a practice and the woman who answered said they do. I wish the school would deal with another bank, one that will not take advantage of students who are already poor enough... What a mean group banks have become... What do others think?

Terrible everything
I am one of the many poor slobs, who is fortunate enough to live a hand to mouth existence. In the past, I admit I have had a hard time keeping up with my account balance and have overdrafted my account. Very frequently however, it would be a very small oversight on my part - to the tune of $5-$10 bucks... never more than $12... and I would promptly go to the bank and hand over the cash to remedy it before I got charged an unmanageable amount in fees. And in the past they would allow me to do this, and not charge me.

Anyway, I decided to begin keeping a register to assist me in managing my account. A couple of weeks ago, I made a mistake in my register, and left out a small purchase of less than ten dollars. The next day I made a purchase of $8.47, not realizing that my account had only $1.89 in it. The next morning I checked, saw my mistake and immediately went to the bank to make a deposit. I deposited $40. Everything was fine, my account balance stated I then had $33.42... and I assumed that I would not be charged a fee, being that I had deposited money so soon after - and that my account had no fees at that point. I later made two purchases one for $4.58, and one for $1.88... and also donated $0.10 to someone online via paypal. Still my account was fine, no fees, everything positive... my balance was $26.86.

The next day I check my account, and lo and behold - it was negative $78.14, I had been charged THREE NSF fees for the initial $6.58 that made my account negative - and now, for the two transactions I made, after I had deposited money. Also, my ten cents donation was no longer on the account - and days later... that went through and I was charged yet another $35 for ten cents!!!

To add to that, I also noticed that I had $7.66 in my savings account... and the overdraft protection I (supposedly) have is supposed to move money from savings to checking in the event of an overdraft. But that $7.66 was still just sitting in my savings. If they had transferred it... my account would only have been negative $0.38... and I would not have been charged so many fees.

So I transferred the $7.66 into my account... and now here I am stuck with a negative balance of $105.48... for having initially overdrafted $6.58... and then due to their delay in giving me fees - another $6.56 in purchases. All of these purchases have been covered both by my deposit of $40 and then my transfer of $7.66. (Purchase total= $13.14, Deposit total= $47.66, Fee Total=$140.00) I have contacted the bank innumerable times to try and resolve the issue... but to no avail. They do not care about their customers, they're only out for a profit. I will continue to call and visit BOA until this is resolved. I will NEVER pay this, and will simply transfer to a credit union - or some other bank where I am treated as a human being - and not a monetary figure. It is excessive, and obviously a scam. They should not be able to conduct such dirty business. I feel like I have been raped, and I am absolutely helpless.

Every time I talk to another representative or manager - they merely keep repeating the same nonsense, about it not being a bank error - so there's nothing they can do. BULLSHIT, they're the bank - it's their company - they have the power... they CAN but they WONT. And although it's obvious how unreasonable this is, they choose to ignore their customer to pander to their greedy shareholders.

Rip-off!
Customer Service through Bank of American should be renamed Customer Disservice. The Bank offers absolutely no flexibility with people who live pay check to paycheck. I was never in the habit of racking up overdraft bank fees until I started regularly using Bank of America. Most banks will allow you to transfer or deposit funds to cover any overage and not assess a fee if the transfer is made same day. Not the case with Bank of America. If your account dips under even for one second and you don't catch it BAM! $35.00 late fee. I think the combined total of dips under that I made was about $28.00 over the 6 months I've banked with them. Money was all put back into the account as soon as I was allowed to transfer it (an issue I'll address in a moment). That $28.00 has resulted in over $490.00 in fees. I feel like I have been raped by that bank! For people that live paycheck to paycheck this is NOT the bank for you! I was drawn in by the supposed ease of online banking but there are no atms or physical bank branches in my area. I cannot even deposit money through another bank's atm (bank of america doesn't allow it). In order to transfer funds from another account online there is a TWO day window. Which means even if I WERE to catch an overdraft before it happens there is no way I could actually get the funds into the account without driving over 100 miles to the closest branch. Some banks offer real customer service. Use one of those. DON'T use Bank of America.

Theft& Calling it Overdraft
I am paid by direct deposit. My deposit came in on the 19th. I looked at my account online that morning and it said I had 210.00. (Direct deposit had come in) Later that same day, I went shopping. B of A overdrafted every single purchase that day. Thats 4 purchases, which did not add up to 210.00. What they did was list the trasactions first, and the deposit last, even though the desposits came in before the transactions. 120.00 in overdrafts, when then money was in my account that morning. When I called coustomer service, they were very rude. Both times. Infact, both ladies seemed to imply that I "deserved it" some how. Refused to reverse the charges. I had to go to the branch manager with my complaint...anyone in that situation, that is the only thing you can do. Warning: They will take your money if they can.

Poor customer service
I had an experience today at Bank of America that I will never forget. The embarrassment and humiliation is completely uncalled for! I DO NOT hold an account with Bank of America so I suck it up and pay their 6.00 fee for cashing my payroll check. When I arrived there was 1 person in line. I, on the other hand had to stand in a different line for non account holders. Well, let me tell you, I was in line for 15 minutes. As people were coming in and out of the bank I just stood there like a dummy. At least thats how I felt. They refused to wait on me. I finally piped up and asked if there was anyone there to assist non account holders. They never even looked at me. Just completely ignored me. A woman from the back came out and stated that their account holders come first and I will not be waited on until the bank is cleared. As people keep walking in. I mean, honestly, have you ever been in a bank that was empty. Heres the kicker...they then asked me if I wanted to open an account. Are you kidding me? You just treated me as if I was the lowest scum on the face of the earth and you ask me if I want an account? Why on earth would anybody want to open an account after being treated like that is beyond me. I will be letting my boss know about their behavior and demand that he close his accounts. I am sure he would not like his employees treated this way by his own bank.

outrageous interest rate hike
I have been a customer of MBNA since 1994 which always had reasonable rates 8% to 9% since Bank of America bought them the rates have been consistently going up requiring numerous phone calls to keep them reasonable. On my last statement it was 12.99% bad enough then I get the statement this month and it up to 27.99!!! I understand this is happening to many, many customers. I believe they are doing this to customers that they know pay on time in order to recoupe loses for their bad business deal ie: Countrywide purchase and bad house loans in general. This has got to be illegal. PLEASE LAWYERS ADVISE. THANKS!! B of A make up any lame reason for increase even if you pay on time and more than minimum.
