Scam and cheating
I had a checking account with the bank for over 7 years and a credit card and a debit card. We had excellent credit wit them. Then my husband got ill and we starting having some problems. But not for a while. We had applied online for a cash advance from our checking account and then declined it and the company did e-mail us back that they had received our decline notice. Well about a week later there was a $200.00 deposit in there from a Fast Cash company? So I notified the bank and told them that that was not authorized at all and they were very rude and said that I must have authorized it because it was done! I said no it was not! I authorized one company and they e-mailed me back but one lady called me on my cell phone and her name is Kendra Beggs and I have not returned her call and she keeps telling me to go online and sign the agreement and I am not going to and she wants to me to go and sign in to their website and I have spammed them out and cannot get to them to stop them because I do not know how to let them back in to get them to stop it and have not been able to reach her back!!

Well they did nothing to stop it and were adamant about the fact that I did it and must have done this. I said to them'Look if you go anywhere and apply for anything, then guess what? you would give them your checking account number, and then your social security number and all that information for them to approve a loan right?' Well that did not happen and even if it did? I did not approve that!!! That was done through our computer through your SSL site!! and you need to check it out!!! I want a fraud alert done and it to be done!!

So about two weeks later what do they do but allow that withdrawal to come out of $60.00 and then again of $50.00 again and two weeks again and two weeks later! So this begins a lengthy process over and over for over a year!!! Then they say if not done in 60 days too bad right? Well they screwed us over a couple of times by messing up and then saying that they did not get the claim request! Bull!! They did too!!

Then finally after a year of this I raised total hell and demanded something be done and so finally they stopped this and put a hold on this and watched for the withdrawal. Then it came through and they ran one for $60.00 and it was stopped so they got clever and ran one for $45.00 instead of $50.00 and did it as a check in my name and what did Bank of America do? Let it go through!!!

Check Fraud this time!!! Then they did not pay it back forever!! So we put a complete hold on the account and total inconvenience and it looked as though the account was overdrawn by $888, 000!! and left it that way. Well they did not tell me that all checks that came through would not be honored! So they bounced all of our insurance deductions and some payouts that were already out and had been paid and never bothered to ask me! So then I got letters from all of these companies for bounced checks and then the Bank wrote letters on our behalf and I had to do all the footwork and pick up all the checks and then give them the letters to get the bank draft fees taken care of. But they did not return the one $45.00 check fraud check back until later on and it caused a time warner check to bounce and then they denied me the $35.00 fee on that one!!

So we had opened another account while I had gone in there one day. This other one we had was opened 7 years earlier. Now they have online another one that shows -$220.00? WHAT? I never even opened that one!! What were they talking about? They never ever returned my e-mails at all and when they did they never ever got the gist of what I was saying and would say they would be glad in helping assist me in opening a new account??? Crazy Crazy!! Total nuts!!

So I said well forget it then I do not owe you money and I do not know what the heck you are talking about with this checking account that I never even opened up? So I left it! Then I opened the other one... Then we had some OD's with that one by being $3.00 off!! And that was their mistake and why? Because I drove up and had the deposit in my hand and made that deposit and asked the girl if I was on time and she said yes!And it would go in that days transactions and I was fine and not overdrawn at all! This was on Monday! From the weekends transactions!! So on Tuesday guess what? 7 $35.00 fees!

I was furious! They refunded 2 and then the girl even admitted what she said to me and took up for me and they still did not do anything!!!

So we ate that one. Then the final straw? I went in one day a couple of weeks ago to make a deposit. The usual thing I do is pay the bills, drop them off at the mail box after 4:00 and then go straight to the bank. So I did and took my check there and had an insurance check and an IRS check with me. Then the girl says to me 'oh, we no longer take 3rd party checks anymore... and... if we did I would not be able to take them anyway because your husband's name is not on the account'.

I said 'what do you mean you do not take 3rd party checks'? What? 'you mean to tell me IRS and State Farm?' She replied yes and 'your husband is not on the account either'. I re-plied 'why isn't he?' 'I applied online as usual like last time and he was on that one'? She re-plied 'No maam you applied in this branch'.

I said 'yes, you are right, but the one I did do in this bank 7 years ago if you go and look at that one guess what?, my husband did not sign on that one either and it was a joint account! I was the only one here that day and opened it for both of us as well as you have some bogus one there online and it states for two of us as well'. And you sent me a letter stating that you just took out $220.00 from my account and then that you were going to turn me in to credit reporting agencies! How dare you take money from my account that you cannot prove that I even owe that!!!

She said nothing at all about that but said 'Mrs Hansen we are not talking about any other account right now but this one.' I said well let me tell you something, you just said that my husband is not on that account yet you have allowed him to write checks in my name for 8 months and that is illegal because I spoke with someone already about this and they refunded 3 of the overdrafts and said that you would return the other 4 of them'. She then stated 'No we will not'. I said to her 'you cannot do that when all this time you allowed this for 8 months and then all of a sudden today after she tells me she does not take 3rd party checks and now you say you do? I drive through and make a deposit and guess what? My husbands name were on them!' Your bank took them without asking one question! So that is a problem now isn't it? She replied 'I am not responsible for what my tellers do'.

I said to her 'I think that you are if you manage this place and tell me one thing and then cause me overdrafts because you did not allow those checks to be deposited and that caused me overdrafts. She then said 'well maybe you should not of paid your bills maam ahead of time if you did not have the money in the bank when you did'?

I freaked out!! I said 'wait a minute lady!' 'How was I supposed to know after 8 months of having this checking account that my husband was not on this account and you have allowed him to write on this account and pay bills for all this time and what if we were divorced? then that is illegal then?! and you were allowing them in!! then all of a sudden you are saying, that you are not taking these checks and I am getting punished for something I had no idea about it and did something I have been doing all along for 8 months and now you say I should of known this and tell me that no one ever does not do that and then go straight to the bank and then deposit the check lady?'! Give me a break!!

She said 'I am not refunding the money and I certainly do not pay my bills unless the money is there first!' And if you want to press fraud charges against your husband you can'. I said 'WHAT?? Fraud on him? yeah right?' You guys are so screwed up!!' You owe me money and it was there!' That is wrong on your part and I do not owe you any money at all and this is totally unacceptable for this practice and I am not putting any more money into this account at all and it will just have to stay overdrawn!! And guess what lady??!!

According to the banking laws? 'It clearly states that if a customer has habitual Overdraft Fees and you just stated that to me and that is why you will not refund our money? Then that customer is not credit worthy! Right? Well then they state in the banking laws that the debit card is allowed to go over if that person is credit worthy! If the customer is a habitual OD fee person then the privileges are provoked and are no longer available to them for the services because the bank does it as a privilege service to that customer because they trust them!' Well we are not too trustworthy don't you think?' And we owe you guys over $5, 000!!! So I would say that does not look to good on our part now does it!? And you just took out $220 that you said we owe you for OD fees which we do not which further would lead me to believe that if I was a Bank? I would certainly cut that customer off!!!

So I think that you guys are scammers and want to make money off of your customers and why do I think that? Because Bank of America is the second largest in the world and lost their butts over the last few quarters loaning to middle class who cannot pay back loans to you! And you can stick it to the man with OD fees and get your money back that way isn't that right???!!

You got in the top 10 list of the WORST BUSINESS LIST EVER!! IN CUSTOMER SATISFACTION!! NO ONE LIKES BANK OF AMERICA BECAUSE YOU ARE UNFAIR PRACTICE ACTS!! YOU DO IT ON PURPOSE!

WHO WOULD GIVE CREDIT TO SOMEONE WHO OWES OVER $5, 000 AND WHO OD'S OVER AND OVER AND HAS BAD CREDIT AND YOU KNOW IT AND HAS A HABITUAL RECORD FOR IT AS YOU STATE?? YET YOU CONTINUE TO ALLOW THAT ACCOUNT TO GO OVERDRAWN UP TO $550?? THE CUTOFF I WAS TOLD WAS $400.OO SO WHY THAT HIGH AND THEN ON THE OLD ACCOUNT WITH FRAUD? GO AND LOOK AT ALL THE ACTIVITY ON IT ON OD'S? AND YOU SENT ONE CHECK BACK 5 TIMES!! WHY??? TO BRING THAT FEE UP BANK OF AMERICA TO $400.00 THEN STOP AND THEN WHAT DID YOU DO?

And when I said 'how about we get copies of all the deposits that have been made to the account and if my husband is on them will you refund the money you would not do it at all and refused me that service! Then I said well I need to talk to you about the other account and not getting back the $35.00 and you said to me 'we are finished for the day and you need to go!'' I said no I want to see the other account and I need some information on it and you refused that too and said you would walk me out!' You flat our refused me service!

You knew you were wrong Bank of America and that is why you refused me those deposits for proof on you because you knew I had you and I will get you trust me. I am sick of you and others like you who bully people like us with your corporate crap and act like that is that! Well I will find a way to make sure you get yours and it looks like others are too!!! Good for us consumers who are sick of you big ole companies who push us around and think we are just going to put our tails between our legs! No way anymore!!!

Research this bank before you decide to open a account with them, you might decide to go elsewhere
Don't trust Bank of America. I can't tell anyone what bank they should do business with. Just be very aware of this Bank and do lots of research about this company.

Late fees
I paid my credit card bill on saturday the 2nd. It was due on sunday the 3rd. I got hit with a late fee which then put me over the limit and and then the over the limit fee kicked in. That cost a total of 70.00 dollars for a bill that was paid on time. This is a pretty nice scam they have going here. Payments made on a weekend don't count but billing is ok. Ive never seen anything like this.The reason they get away with it is because the idiot senators and congress are asleep at the switch. Write to the senate and house banking committees as well as the Office of the Comptroller of the Currency and complain. Support term limits in the congress so we can get rid of the corrupt congressmen who sit on these committees. There is a word for this and it is called fraud.

New ATMs
The new ATMs are horrible for making deposits. Previously, checks were tallied and put into an envelope. The total was input into the machine and the envelope inserted. Two minutes tops. Now, each check must be scanned individually. Half the time the scanner does not read the number and you must zoom in to see it and input it yourself. It takes about 30-60 seconds per check. For someone like myself, self-employed with many clients and many individual checks per week, it now takes about 10 minutes to make one deposit. Then I have to re-scan my card to make a second deposit into a different account. Need I mention how irritated the people behind me are? Of course BOA didn't think to put two machines in each location. They claim that by the end of the year they will have machines that can read 10 checks at a time. I won't hold my breath. What were they thinking?????

Use caution when opening accounts
Applying for an account with Bank of America will probably get you an account, but not the one you applied for.

I applied for a line of credit with the advertised rate of 8.99% interest rate, my credit score is in the high 700's.

I was denied credit.

I received a 10, 000 credit line with a 21.99% interest rate 4 weeks later that I didn't apply for.

When I phoned they closed the account but refused to remove the tradeline from my credit report.


Thus it shows me opening and closing an account. For those of you who aren't familiar with reading credit profiles, this looks unfavorably when applying for credit.

Apparently 8.99% is false advertising, or only one available at this cost (like a car dealership).

Also, opening an account without your permission/authorization may be considered fraud.

Overdraft fee
This complaint post is for my daughter. She had 4 overdraft fees taken from her BoA account recently. The problem arises in she had transferred money from her savings into her checking (both BoA) on the weekend. All the transactions posted the same day, however, before the pending transactions went through, the overdraft fee was calculated putting her in the red. So, when the transfer posted the same day as the debits (I am sure the debits were first-all little amounts under $10), she incurred 3 more nsf fees. Now she is in the red with no way of putting anything in the account. If the first nsf had not been calculated with pending but not posted transactions, this domino effect would never have occurred. We filed complaints with the Federal Reserve (on their website), The FTC (from website), and the BBB about these practices. The Fed Reserve claims to investigate complaints. I do not know what they do if anything, but what the heck? Too bad they do not realize without customers, they have NO business! More corporations need to realize that the BIG accounts are not the biggest part of their business, but it's the "little guy" who keeps them running. In my biz, I would rather have 20 small accounts, than 2 Big accounts. I may go to a lawyer if we receive no satisfaction at the local branch. Or... perhaps we all need to ban together somehow and create a petition if it has not already been done.

Unauthorized billing
The other day I looked at my Bank of America checking account and found out that I was $19.00 overdrawn on my account. Four transactions had caused me to go over only $19.00. I couldn't figure out why I had gone over so I went back and looked at my statements and found that back in May 2008 that I was charged an overdraft fee, yet my account never showed to be overdrawn.

I went to talk to the branch manager, but he was out of town so I talked to one of the Banks financial managers. He told me that it was because I had gone over my limit. My account showed to be in good standing and he said that was because the same day that I went over that I made a deposit, but the deposit was after I made the transaction.

For years, Bank of America has maintained that if you are able to bring your account current before anything posts that you will not get any fees. However, the financial manager told me that they had just introduced a new policy stating that if you go over your limit you will get a fee and it doesn't matter if you get funds into the account the same day or not.

After this I showed him that the same thing happened in June 2008 where I went over and brought it current the very same day, yet there was no fee assessed. I asked him why I got a fee in May but not for June and he could not tell me. He told me that I would have to talk to the branch manager, the one who was out.

I came back and tried to talk to the branch manager but he was still out. So they told me to talk to the second financial manager who told me the exact same thing as the first, but like the first person I talked to, as soon as I presented my case about doing the same exact thing twice but only getting a fee the first time, she just threw up her hands and told me that I needed to talk to the branch manager.

I came back into the bank the following Monday to talk to the branch manager, yet he was still not back and I was told that he would be the next day. By this time the four transactions that caused me to go over by $19.00 had each received a $35.00 fee so my account was now over by $159.00.

I went to another local branch and talked to their branch manager. After presenting my case to her she sided with me and said that I should have not gotten any fee back in May. She told me that she would credit me back the $35 dollar fee from May. Now I thought that this would automatically cancel out the others. After all, if I had not gotten the $35 dollar fee back in May by account would have been in the positive by $16.00 and I would have never gotten the other four fee's. However the next day when I check my account, not only was my account still over, Five more transactions had come in over night and each one of them had a fee of $35.00 tagged on to them. So now my account was over by almost $400 dollars.

I called the bank and told them what had gone on and that I talked to a girl named Debra, a branch manager, who said that she was going to remove the fee from back in May. I asked why it did not erase the fee's that I have currently and I was told that all fee's had to be removed manually. I asked if I could get the others removed and I was told YES. I was placed on hold and after a few minutes the person comes back on the line and tells me that his computer will only allow him to remove 3 of the fee's. I asked him why and told him that if I had not gotten the very 1st fee then my account would not have gotten 4 more fee's which caused the $140 dollars in fee's to come in which in a chain reaction caused 5 more transactions to come in overdrawn causing $175 dollars in more fee's. The person that I was talking to told me that they understood my situation but that they could not remove any more fee's. By the time that I got off the phone it was about 5:30 and my local branch was closed so I decided to go back into the local branch the next day.

The next day I go into my local branch and talk to the branch manager who was finally back from his vacation. I talk to him and tell him my whole situation. My wife also had come into the bank with her payroll check which would have put us way into the positive but only if the fee's would be removed. If the fee's would not be removed then my wife's entire paycheck would get eaten and we would have still been in the hole about $150 dollars. After talking to the branch manager, he too sided for me and said that he would remove 'some' fee's. He too said that the computer would only allow him to remove 3 fee's and that I would have to call the bank call center to get all the fee's removed. He told me that the call center had the power to remove all the fee's but that at the bank they did not. I don't understand why he did not call the call center for me but whatever. I asked him why I had gotten the one fee but not the other and like all the rest, he tried to explain what he 'thought' might have happened, but wasn't for sure. He even told me, just like the first manager that I talked too, that if I am able to bring my account current the same day that my account goes over that I would not get a fee. So did I cause my account to go over, YES and I admit that, however as soon as I realized it I brought my account in good standing the very same day by depositing money back into my account. This I was told would not have given me a fee, yet I got one. Remember that I went over and brought it current the same day both in May and June, but only got a fee for May. Remember that my statement also shows that back in May that I never went overdrawn on my account because I made this deposit. Same thing goes for June.

I called the call center again and talked to a woman and explained to her what was going on with my account. She refused to refund any more fee's because she explained to me that I have had over 20 fee's removed off of my account in the past 3 months and that there was nothing she would do about the current situation. I asked her even if 2 different branch managers had decided that this current situation wasn't my fault and all I got was an 'I'm sorry, there is nothing I can do'.

Let me back up. I'm sure that your wondering why she said over 20 fee's. True, however two months ago back in May my niece had a baby. My wife and I went to the gift store and bought a $7.00 stuffed animal for her and the newborn. When I checked out a local volunteer, an elderly woman about 95 yeas old had checked us out. Mistakenly she charged my account $700 dollars instead of $7.00. Mistakes happen and I know this so I wasn't mad because I knew that it would all work out and that any fee that I got(because my account was now overdrawn) would get credited back to me. I went and talked to a hospital manager and she immediately refunded the $700 and charged my account the correct amount of $7.00. It took about two weeks for the $700 credit from the hospital to go back on my account. During the time of waiting, the bank had charged me 12 fee's and one overdraft fee, a total of $430 dollars. As soon as the $700 dollar credit came in from the hospital came in I called the bank in which they gave me credit for all $430 dollars. No problems what so ever. So that's why the lady that I was talking to said that I had over 20 fee's.

I tried to explain this to the lady that I was talking to and told her that the incident with the hospital was not my fault and two branch managers have sided with me that this current issue is not my fault either and have refunded $245 dollars worth of fee's but says that the call center has to remove the rest. However this lady refused to hear me out. In total I have talked to at least nine people and Bank of America refuses to remove any more fee's. The incident with the Hospital has marked me a a terrible customer who can't handle their finances even though it was not my fault and so has this current issue who at least 3 people, 2 of them managers, have told me that it wasn't my fault. If it is not my fault, then why won't Bank of America remove the fee's that I have gotten. This all boils down to one fee in which I was told by two different managers that I should have not gotten. But because I have had so many fee's removed the bank has marked me as a terrible customer and won't remove any of the fee's. If all the fee's were removed they I could get my account back in good standing. Bank of America has even started rejection payments and giving me a fee every time that they reject a transaction. The fee's keep coming yet there is nothing they will do even though I was told that it WAS NOT MY FAULT!!!

I went and talked to a hospital manager and she immediately refunded the $700 and charged my account the correct amount of $7.00. It took about two weeks for the $700 credit from the hospital to go back on my account. During the time of waiting, the bank had charged me 12 fee's and one overdraft fee, a total of $430 dollars. As soon as the $700 dollar credit came in from the hospital came in I called the bank in which they gave me credit for all $430 dollars. No problems what so ever. So that's why the lady that I was talking to said that I had over 20 fee's.

I tried to explain this to the lady that I was talking to and told her that the incident with the hospital was not my fault and two branch managers have sided with me that this current issue is not my fault either and have refunded $245 dollars worth of fee's but says that the call center has to remove the rest. However this lady refused to hear me out. In total I have talked to at least nine people and Bank of America refuses to remove any more fee's. The incident with the Hospital has marked me a a terrible customer who can't handle their finances even though it was not my fault and so has this current issue who at least 3 people, 2 of them managers, have told me that it wasn't my fault. If it is not my fault, then why won't Bank of America remove the fee's that I have gotten. This all boils down to one fee in which I was told by two different managers that I should have not gotten. But because I have had so many fee's removed the bank has marked me as a terrible customer and won't remove any of the fee's. If all the fee's were removed they I could get my account back in good standing. Bank of America has even started rejection payments and giving me a fee every time that they reject a transaction. The fee's keep coming yet there is nothing they will do even though I was told that it WAS NOT MY FAULT!!!

Unauthorized charges
I want to report on Bank of America's shady policies concerning overdraft fees. I deposited a check into my account one day last month. I waited for it to clear, and when I returned to the bank, I was told the check HAD CLEARED and that I could draw on the money. My wife needed to make a wire transfer abroad, and after getting the bank teller's assurance that the check had cleared and that the money was in our account, she made the transfer.

A week later I am in the bank and make another deposit. Things are fine until I go online later that day to make an online payment and notice that my bank account is overdrawn $900.00!!! Now I was just in the bank earlier that morning with a teller smiling at me. Could she not have mentioned I was $900.00 in the red?

Anyway, I go to the 'Personal Banker' immediately to find out what happened. Apparently, the check I had deposited a week earlier had bounced, AFTER my wife had already made the wire transfer with money that was not in our account. So even though I was told by Bank of America's own staff that the funds were available, they actually were not.

I asked the Personal Banker why my wife was allowed to make a wire transfer of $1500 dollars when the check hadn't cleared, and he responded that because I was such a 'preferred customer, ' the Bank gave me the courtesy to 'forward' me the funds (Of course, overdrafts would be charged for the courtesy.)

So now I'm overdrawn $900 dollars, and overdraft fees start to avalanche on me. Bank of America takes no responsibility, and the Personal Banker tells me that 'the computer' won't let him remove the overdraft fees. The Personal Banker also TOLD ME that Bank of America used to not allow customers to draw on funds that were not in their accounts, but that now they DO allow this because overdraft fees are such a large part of the bank's revenue.

I had been a customer at Bank of America for 15 years. I regularly make wire transfers at $50 dollars a pop. This bank may have made a mere $120 dollars on me this time, but they lost much more in potential future revenue. I hope I might warn others about Bank of America's policy.

Do not, I repeat, do not draw on any account until you have absolute proof that your check deposits have in fact truly cleared. Even the bank tellers will tell that you checks have cleared when in fact they have not cleared. If you then draw on these accounts you will be penalized with expensive overdraft fees. I recommend getting a hard copy of cleared checks before any more transactions with your account are made so that you can protect yourself from consumer exploitation.

Bank of America, as subtly told to me by the Personal Banker, relies on CONFUSION and MISCOMMUNICATION to lure you into this kind of mistake. This way they can hit you with several OVERDRAFT FEES. Then they will blame it all on the automated 'computer' system which cannot be over-ridden by the Bank of America staff. How convenient for them to pass the blame onto the faceless master computer.

This experience, along with a few other customer nightmares Bank of America has given me, has made me realize that big international banks cannot service the average American consumer. I am moving my accounts to a smaller local bank and I recommend others do the same. 15 years of customer loyalty meant nothing to Bank of America. I guess my next wire transfer fees will go to another bank now.

Scam and theft
Its not so much that I get charged overdraft fees for going over my account balance when using my Visa check card. If I go over and get charged a fee, I deserve it. Its that BOA's online banking is designed so that you are FORCED into overdraft fees. Let me explain what happens and if you are a lawyer, please contact me because I want to sue this institution on behalf of EVERYONE LIKE ME THAT GOT RIPPED OFF.

Example: Lets say you don't have $10000 in your account at all times. If you did, there wouldn't be a problem. The problem arises when, like me and every hard working American who because of the economy or other situations, is forced to live paycheck to paycheck. Lets say are coming to the end of the week and you only have $10 left in your account. You get gas and you accidentally pump $11 in gas. You do not get paid for another two days so your account online is shown in red (negative). You borrow money from a friend to cover the charge. Its past the cutoff time at the ATM, but to make amends you deposit $11 in your account to cover the overdraft. You check your account online and it shows you have a positive balance of $10. You wake the next morning and your account is still positive so you figure you got the money in on time. Wrong! You got the money in past the cut-off time, so the money will not post until the end of business the next day, but the online banking shows a positive balance. You therefore decide that you still have $10 and so you use your card to make purchases. Lets say you make 4 purchases for $2 each and 1 purchase for $1.99. You check your account that afternoon (the day after you overdrafted and made the deposit) and your account shows a balance of 1 cent. You go home figuring you are OK, but instead you get screwed by BOA. That afternoon after the cut-off time, they charge you the $35 fee for the original overdraft. Being they use the 'largest transaction first' this fee gets placed for posting first and your 5 charges (worth $9.99) get placed in order of amount after that. Therefore your balance shows you being in the red for $44.98. Worse yet, now the five transactions you made will get overdraft fees if you don't deposit another $44.98 in your account by the cutoff time. The problem lies in that in most circumstances they post the $35 AFTER it is too late to make a deposit to cover the overdraft, therefore you are caught in a vicious circle of overdraft fees which unless you deposit a huge amount in the bank you cannot get out of.

I have spent well over $4000 in fees this year ALREADY and its only July. I have finally decided to drop the BOA account and get one elsewhere. I should have done it MUCH sooner. I should also have kept a written register of my transactions, but BOA made me feel as if their online banking was excellent.

If there is an attorney out there willing to take my case, please contact me as I will certainly jump on board and I am sure there are PLENTY of people out there like me, that has plenty of evidence to prove my case.

Moral of the story is STAY AWAY FROM BANK OF AMERICA.
