This review was written by Mr. Krishnamurthy and his spouse Mrs. Raksha Krishnamurthy who live in India. The Krishnamurthy family engaged Healy Consultants Group PLC through a retainer fee to register a company in Panama and supply them with warehousing space, banking and staffing solutions; They settled a retainer fee of US$5,000 after 1 week of email preliminary discussions. Immediately thereafter, our Singapore team engaged in a lot of research to supply a detailed project plan (http://www.healyconsultants.com/example-detailed-project-plan/) for their business set up; As the engagement progressed, The Krishnamurthy family supplied us some Know Your Customer due diligence documents about themselves. As they did, we realized they were representing a third party. Our Firm continued to highlight to them our legal obligation to also collect i) a signed engagement letter and ii) Know Your Customer (KYC: http://www.healyconsultants.com/company-formation/due-diligence/) documentation from all parties to an engagement. These KYC requirements are also transparently highlighted i) in our engagement letter ii) on multiple pages of our website (such as http://www.healyconsultants.com/guideline-of-measures-of-client-due-diligence/) and iii) in all of our invoices (see for instance this page for evidence of the same: http://cdn1.healyconsultants.com/wp-content/uploads/2014/08/draft-invoice-Singapore.pdf); We additionally informed the Krishnamurthy family that the Panama Registrar and banks would also require most of these KYC documents, before approving company registration and bank account opening. After several weeks of email and phone requests, the Krishnamurthy family refused to supply accurate and complete Know Your Customer due diligence documents. They were representing ‘’beneficial owners’’ for which they refused to disclose nor supply Know Your Customer due diligence documents about this mystery third-party. In our experience, this is a serious red flag. We refused to advance the engagement further. In accordance with Singapore regulations, we consequently had to terminate the engagement and refunded them US$2,500; Because we supplied them with i) a detailed checklist of due diligence obligations ii) project plan and iii) project managed their engagement for 3 weeks, we kept the remainder of US$2,500 for time spent to date; As a side note, Mr. and Mrs. Krishnamurthy initially contacted us to register an LLC but later asked for the registration of a sole proprietorship instead. It is true we never registered such an entity in Panama, because no multi-national Clients' ever asked for such an entity. Only self-employed Panamanian citizens use this entity. Healy Consultants Group PLC are usually engaged by multi-national Clients'. Our company advised against such an entity, because a sole proprietorship does not offer the protection of a limited liability to the business owner, exposing the couple to unlimited reputation, litigation and financial risk. If the Krishnamurthy family had supplied us the requested Know Your Customer due diligence documents, we would have enjoyed the challenge of timely accurately and completely supplying quality business solutions in Panama. It was an interesting engagement.
