No lien holder of record with the two companies that they say have my loan modification. I checked with J.P. Morgan today. they have no record of a loan modification that was supposed to take place 8-1-08, I sent back the loan modification papers on 7-22-08 with a check for $1704.00. Despite repeated requests, they refuse to send me back the loan mod papers signed by J.P. Morgan Chase. Now, I know why, I do not have a loan mod with Chase per my conversation with them today, October 8, 2008.
Spoke with Erica. I received a letter from Saxon on 9-18-08 stating that my lien holder was Wachovia and they were foreclosing on 10-18-08. I called Wachovia today and spoke with Ellen Maslar. I have no loan with Wachovia. On 9-2-08, I spoke with Rosa from Saxon, she said I was still in loan modification and not to worry about the payments. Meritech has reported me late as of July, 2008. I was in loan modification then. I have filed a class action suit against Saxon with Craig Hosay, Esquire . My congressman, in Florida, has filed a complaint for me with the Department of Financial Services. I have been advised by an attorney, not Mr. Hosay, NOT to send them any money until I have fully executed documents and disclosures signed and notarized by all parties. I talked to Andrew, supervisor at Saxon last week. He admitted that he did not know who my lien holder was. Asked me to fax letter dated 9-18-08 to him and he would get back to me. As of today, he has not done that. Still, they are foreclosing on the 18th of October. I wonder who is foreclosing on me and for what reason. I either have no loan at all, which is hard to believe, or I am still in loan modification, which must be the case. I am confused. i believe that i will be receiving help on this from the State of Florida and from Mr. Hosay. Hope this helps some of you. I will keep this site apprised of any new developments.
