I purchased a pairs of shoes from www.shoebuy.com on 4/27/09 and didn't get a chance to wear them within the time they were purchased due to the fact I was moving out of state.
When I finally wore the shoes to a function, the right one was visibly a size too big and too wide kept falling off my foot. Unfortunately I was months out of the 90 day return and exchange period but I took a chance and called customer service anyway.
I spoke to James in customer service, and honestly informed him about the situation by telling him when I purchased the shoes and that I wore them once and the issue with the shoe. I was told that if the shoes was defective I could send them back and would be refunded my funds minus shipping and handling. I asked for a return label, and they said I wasn't entitled. I kept calling and the company grudgingly emailed me a label which I used to return the item.
I checked frequently to see if they received the shoes until they finally did and was told by a male customer service representative they were looking them over and in 48 hours someone will call me. That call never came.
Almost a month went by and I heard nothing so I called to check the status and was told that they mailed the shoes back to me. I was stunned, since I was not informed of any decisions made about the shoes and asked why was I not contacted? I was told by James that they did not examine the shoes yet. I was a bit upset and explained I was given a different story 3.5 weeks prior.
I pride myself on being honest and straightforward, and before returning these shoes I had four people look at them on my feet and watch me attempt to walk in them just to be sure I wasn't imagining things or being unreasonable. Yet this the reply that I received.

Thank you for your patience while the review of the images were
underway. Unfortunately, upon our review of the returning shoe, the
results of this comprehensive review determined that the condition was
not related to a manufacturer defect. As the condition of the worn shoes
was not a manufacturers defect, we could not accept them back and they
were returned to you as is.
As it is this and our other policies that allow us to continue to offer
the vast selection, free shipping of orders to our customers, great
prices and other features, thus we cannot make any exception to this
guideline within our policy,

As we recognize this may not be the conclusion you wanted, we hope that

I honestly wish the photos were smaller so I could attach them to this complaint. It is very obvious that one of the right shoe is way larger in length and width. I am unable to upload the 3 pics they took of the shoes because the max size is 2MB.
