Has Spencer Kobren Violated FTC Disclosure Guidelines re: Dr Payments in excess of $600.000 ?
Disclosures are important because an act or practice is deceptive if it misleads “a significant minority.” This is the rule of the Federal TradeComission.
Unsuspecting consumers may not realize that a celebrity (such as a radio personality) endorsement of a medical procedure has been paid for doing so. Knowledge of the payments would affect the credibility a consumer would give to the endorsement. Without a clear disclosure of the payments made to the celebrity, the endorsement is likely to be deceptive.
Spencer Kobren is a paid endorser radio personality, . His IAHRS surgeons pay up to $12, 000 each for membership in SpencerKobren’s organization.With over 50 members Mr Kobren receives over $600, 000 in payments .SpencerKobren’s failure to disclose these payments is deceptive to his listeners, viewers and reader members.
This violates new FTC guidelines and possibly Truth in Advertising Statutes.
