Good day,

I am from the West Indies and recently purchased a shipment of mobile phones from China. US is used as a transhipment point for our goods and the phones were stopped while passing US customs to its destination country, Trinidad and resent to China. The reason for stopping the shipment given to me by FEDEX was the phones were counterfeit.
These phones are China mobile phones and although I agree they have the same model number/name as the Sonyericsson they do not carry the same brand name or is even a copy of that phone.

Was it legal for the US customs to stop the shipment even though the brand name is different? Can you please you advise on what I can do in this situation as all the shipping fees have to be paid by me and I am hoping the vendor gets back the phones in good condition for him to resend another shipment.

NOTE: This could happen to me again as I am an importer of mobile phones.
