Racial discrimination
Dicrimination report against Bank of America 02/09/2011
Overlake park banking center.
On Wednesday Feb 09th 2011 I went to the bank of America Overlake park to deposit my payroll check.
It has been the only bank that had been accepting my
Check and giving me immediate Funds with few questions to ask. The amount of the check was 1054.29 which is the same amount every week.
I talked to a teller called Luba Lyubov but she refused to take my check saying she would put a hold on the check for two days but I tried to argue with her saying that she was profiling me. She called the assistant Manager PEGGY
GRINNELL. This manager was very rude and asked me to
Leave and deposit the check somewhere else.
I left the bank shouting very loud RACIST BANK THIS IS!!!
Immediately went home and got my wife Cleona J Filho and asked her to go to the same bank and deposit the check. She went to the same branch (Overlake park)
I gave Cleona the same check for 1054.29 and she went in and talked to a teller called PACHIA who had no problem giving her immediate fund without any questions to ask.
Once more I felt discriminated.

Discrimination and racism.
Discrimination claim against Bank of America.
On January 5th 2011, I Antonio R Filho went to bank
Of America on 10555 NE 8th ST, Bellevue WA 98004.
I drove to the window of the building to make a deposit of
Payroll check in to my checking account. The teller advised
Me that my check would be on hold for 2 days before I could
Receive any funds into my account. I said that I would like to
Talk to the manager and she asked me to come inside the building.
Once I got inside the building I was helped by this lady called Gloria (Manager of that branch). She redirected me to
To talk to Mr. Brian S. Jones ( Senior Vice president).
He told me that my check of 1054.29 was too much money
And that check WOULD NOT HAVE IMEDIAT FUNDS AVAILIBLE TO ME THAT DAY. I tried to understand the
Problem but because this happened twice before with me I new that it was because of my SKIN COLLOR That he was
Not going to release the funds. I asked him to check my
Account history on that check for the fact that it was a PAYROLL CHECK that was deposited every week but
He asked me to go to another BANK.
I went home and asked my wife to come with the SAME CHECK and deposit it into our account. SHE HAD NO PROBLEM WHAT SO EVER WITH THE CHECK.
They gave her immediate funds to her but 2 hours before they
Said no to me.
This happened to me 3 times now and I’m tired
Of being discriminated by this bank. I am an American
And it does not matter if I’m not white and my wife is,
I still want immediate funds when I go to a back if that
Bank offers that to there customers.
Please help me to stop this from happening to anyone
Who might try to go to that bank or any other bank that
May be practicing this kind of discrimination.
Thank you.

ach
I put a stop payment for ACH in the amount of $80 and $168. They told me that it would cost me $30 in which I paid. they said although it is 2 transactions for same company not to worry. 3 days later $168 was taken from my account along with a NSF of $35. I then called the claims dept. and said to file a complaint and that they were sorry for this should have not happened but in the meantime they would credit my account the $30 in which I did. 2 days later $80 was taken from my account. I am filing a complaint tomorrow but since when does BOA return funds that allowed to be taken out of account when I signed a waiver not to have an overdraft policy in the first place and paid for a stop payment fee. Claims department also told me that that they are not suppose to tell customers that a ACH stop payment is not guarenteed but yet they will not tell you that at time receiving there $30 fee.

Fees
First time I have ever posted a complaint, but I have been pushed too far by BOA. I just opened a new business, employing 15 people. Doing my part to help the economy. 90% of my sales are credit or debit cards. BOA will hold my credit card deposits for 2-3 days, waiting for a bunch of checks to come thru. They then post the checks and the very next posting will be my credit card deposits. This enables BOA to charge me $35 on each item. Not only do they hit me with an NSF fee, but they return the checks causing me to pay the vendors a $25 return fee. So, I am spending $60 per check in fees to bank at BOA. I never write a check thst I know the previous days credit card sales can not cover. Again, BOA will hold my deposits for 2-3 days so they can nail me with fees. This has to be illegal and something needs to be done to stop them. I live in an area of less than 1000 people and I have found over a dozen of local businesses that are having the same experience I am. This should qualify as a class action suit. Banks like this pushed this country to the brink of a collapse, had to be bailed out by us, the tax payer, and how do they say thanks? They sit up at night finding new ways to screw the very same taxpayer. Somebody, PLEASE start an effort to start a class action suit and get congress to launch an investigation.

Applied tax shortage payment to a late charge in dispute
Bank of America is assesing late charge that I did not incurr in the amount of $ 96.83 from the month of December 2009. I sent them proof that I do not owe this amount; but they keep including this late charge on my monthly statements. In March 2011 the statement of acount showed the late charge again. I did not pay it. I made my March payment in the amout of $ 2, 575.43. Bank of America did not post my payment when they received it on March 4, 2011, argumenting that it was a short payment. On March 17, after the grace period, I received a call from a loan officer stating that I will be assesed a late charge unless we pay, right away, the amout of $ 95.25. When I asked why, she said that it was because there was a shortage in my Property Taxes which said charge was never disclosed in my account statement. To avoid the harrasment I paid it; but it was posted, without my consent, to lthe late charge in dispute. Sincerely,

loan modification
my sick and elderly neighbors tried for a loan midification on their home for over a year. as of two days from now they will be thrown out of their home with all their belongings. boa strung them along for over a year, telling them they need more info, they are working on the loan, etc. they were told not to make house payments or they would not qualify. as of 3 days ago, their home was sold at auction. he is 75 years old with congestive heart disease and copd. she suffers with ms. how can this happen in this country? my heart is breaking for them and the scariest thing is that this could happen to any one of us. when will our government wake up and do something to stop this bloodletting by these banks?

Privacy assist scam
Bank of America sent me a Privacy Assist form to fill out and sign if I wanted the service. However I did not so I never sent in the form but Bank of America started to take out the fee for Privacy Assist on a monthly basis. When I called and asked them to stop they said no. I then said I wanted my account closed and they also refused to do. Feeling the only option left to me I drew down my account balance to 1.74 as to prevent them from draining more 12.99 monthly fee for the service. That did not stop the bank which just kept on pulling the fee out and charging an overdraft fee. I felt I could do nothing until a friend told me what I could do to stop the situation. I threatened to sue. I was given Privacy Assist phone number and the company said that they would refund the money but Bank of America claims that they never received the money. Now online I am finding many web sites that have people citing the very same issue. Bank of America and Privacy Assist are a scam by both companies and they are getting away with it. I have since opened an account with chase but chex systems has put me on a restriction list for five years so for the next five years I cannot write a check nor us my debit card for large transactions like paying rent and i have to pay five dollars for a money order at my own bank and pay a 15 dollar maintainence fee plus I cannot take advantage of direct deposit or multi card use to avoid monthly fee. My credit has been wrecked and I have filed a complaint with the attorney general in my state but they told me it is near impossible to fix credit once a bank destroys it.

Horrible customer service
A client in Canada had to send us a check for services. He went to his bank and got all of the information he needed from me to send money direct from his bank to my local Bank of America. Apparently the "name" they asked for wasn't the contact name, but the business name and the wire didn't go through. Bank of America immediately took $40 from the transaction. No wonder they make so much money when hitting up small businesses with frivolous fees for poor instruction.

Bad service
I was recently laid off from the bank. They are shipping the computer jobs to India and then claim they are an american bank. I called up to get information on my 401k but could not remember my password. Got someone in India. I was told I could not have my password since I did not work for the bank anymore. I told him I was considered a retiree. All I could get from him was a "you dont work for the bank so I cant give you your password to get to your 401k" at least thats what I thought he said but could not really understand everything he was saying. So am still trying to get to my 401k but everytime I try I get someone from India who cant speak english and wont help. Moving my money to Wells Fargo.
