I signed a fee/retainer agreement with Schonberger in April 2009 and never used his services. He also never sent me a monthly statement reflecting any services or work performed.

I requested a refund in February 2009 since he never performed any legal services and the agreement we signed said that the retainer was refundable minus a $125 consultation fee if I chose not to use his services.

He refused to return my money based on his having it for the last 8 months even though the contract has no expiration date or statute of limitations to that effect and was not a blanket retainer, but instead an agreement for a specific task, which he did not perform.
