Fraudulent Loan Servicing
We just received notice that the servicing of our mortgage loan was transferred from CENLAR to Ocwen. After looking online for information I am extremely concerned about dealing with these people on a loan modification. Are they any suggestions from other people in similar circumstances about our options or how we should proceed within this first 60 days?

Foreclosure
I have been in foreclosure for about a year now due to my employer cutting our wages and laying off drivers. I have asked Ocwen for help in this matter.
I have submitted a Hardship Affidavit for the second time. The first time they claim they did not receive. So I sent it certified mail this time.
When I asked why they didn't let me know they did not receive it. They had no answer.
To sum it all up. I am getting the run around. In the mean time I have gotten my finances in order so that I can pay my mortgage.
When I try to call I can rarely get through to anyone. The times I have gotten through I get someone that cannot understand me or I can't understand them. They are usually in India or Paraguay! PARAGUAY! Are you kidding me?
Well I have had it and do not know what to do anymore. I have done everything this company has asked of me and they always seem to want something that they never wanted before. I am ready to tell them to keep the house.
They call and I answer and it's a recording. I call back and get nowhere! I have left messages for ext. 6403 and never get a call back.
I guess it's hard to call from India! Does anyone have an answer?
I need help and not another scam!

Fraud
This company has tagged on additional payment amounts to my original note and demanded I pay almost 14k in one month. When I did not they placed 700 plus on each monthly statement claimining I was late. My attorney jumped on this and helped some but this comapny conitnues to think harassing ac ustomer up to 10 times in one day and then having people that do not have information other than a screen wto waste time and disparage you on the phone. Since when do companies have the right to increase your payment by more than triple!!! There has to be someone to handle these issues as a central location.

Propery theft
After signing purchase agreement and Loan Documents. OCWEN contract out a company to Mow my back yard and take away the debree such as cloths planted in the grass. My pool sweep I took to get fixed and left the hoses. Mind you they hired thiefs they came to the house to mow and broke every sprinkler in the back yard along with the debree went into my pool in which they had drained and refilled as requested after I signed Loan Docs know my pool is green and gross. They stole my Pool sweep hoses (cost appx 369.00) the bricks that where there and took 1/2 of the cabinets out of my garage.Along with the Planters from my yard. Also if all else said. I had tools and new water hose, friends yard tools and ladder and misc new stuff. Also I purchased this house as is with these items there. I have got the run around with AMIT, Poonam, Tara, and spoke to Selva I have been promised call backs and that this issue would be resolved. I sent emails pictures and still never got a call back

Worst company ever
March 2009 my husband and I applied for a home loan moidication under President Obama Plan. Weeks and months went by we hear anything and when we called we were put on hold for more than 30 minutes every time. I decided to hang up and I called again the customer service was very rude with very heavy accent and asked me why I had called and I told hime I would like to know if your received my packets and faxes and he didn't say anything and put me on hold again. about three months later we received letters after letters stated that they didn't received all paper and missing signuter. The letters we received was so confusing they sent letter date 7/20/09 and my documentation needed to be mail by or fax by 7/18/09, then couple day later we received other letter form Ocwen again letter date 7/22/09 and my documentation needed to be mail by or fax by 7/18/09 on and on. Finally, we submitting documentation after documentation as requested.

On August 2009, we received a letter from Ocwen that we qualify for loan modification, but they offer us three months trial for $1513 and after that they would work with us. The letter didn't explain much what my future payments would be and we refused to sign the contact. My husband called Ocwen the next day to explaning the situation that we couldn't afford the payment and finance solution we are experiencing and my husband asked to see if they have any other options or help. Ocwen reply that they going to sent us a new packet for a loan modification.

10/05/09, We received certified mail from Ocwen stating that we own $16k and we have to pay by the end of Oct 31th, 2009 or my house would be foreclosure. I couldn't sleep all night because I was to depressed and kept thinking where am I going to ge $16k, if I can not afford $1513. The next morning I called a program HOPE for help and explaning my situation and HOPE was on the phone with Ocwen and their going to sent me other packet for a loan modification.

Ocwen is the worst company claming to help homeowner and the worst customer service ever. If we all complain your voice will be heard ans we can make a difference to take this Ocwen down and file a class action lawsuit.

THEY DON'T GIVE A DAMN ABOUT THEIR CUSTOMERS
My husband had a loan through People's Choice Home Loans, who subsequently sold it to Ocwen. About 2 years ago we were solicited by a 3rd party debt counseler, someone who called himself Professional Credit and Forefront Financial Services, located in West Hartford and Cromwell Connecticut. Long story short, he scammed us, promising to negotiate with our lender to secure a loan modification, to which he never did. In fact what he DID manage to accomplish was filing a pro se appearence and bankruptcy on my husband's behalf, FORGING the documents and his signature, and putting us into strict foreclosure.
Because the law day has passed we keep being told that there is nothing we can do, and apparently Ocwen doesn't care if you've been scammed or not. In contacting the Attorney General's office today (9-14-09) I was informed that there IS in fact a pending criminal investigation, and that really all we can hope for is to be placed on a list of other people that this guy has screwed. While it offers little consolation that he's done this to others, we're still out any money that we could have hoped to used to move or hire an attorney, forcing ME to represent us, starting with a motion to reopen the judgement of strict foreclosure. Evelyn Pierre at Ocwen is the woman I spoke with, and quite frankly she was very VERY rude to me, and the last time I spoke with her, convieniently enough she has no record of such conversation, when I asked for her supervisor, she HUNG UP ON ME. They sure as hell don't seem to care that while my husband is self-employed, he works here at home, as an auto mechanic, so if they take our home, they take away his source of income.
If anyone has any ideas on what avenue I can take now, please PLEASE let me know. I can't let my family become homeless. We have children here, and they can't end up out on the street.

Seeking whistleblowers for mortgage fraud
I am seeking anyone who has knoweldge of the way in which these companies operates its business. I am seeking information which points to loan gaming, forced placed insurance as a means for obtaining property through foreclosure, incentives for foreclosing, setting up escrow accounts for perpetrating fraud. Any information of violations of sarbanes oxley, tila. i asm also interested in learning about ach payments and predatory lending practices within the company. I am particulary interested in hearing from you if you have worked for the company.

Short sale
I had a short sale going on with Ocwen. They denied the first offer, then the buyer raised the next offer. Ocwen denied it and NEVER informed ME or the agent that they denied the offer and claimed that they send be a letter notify me, which to this day I have NOT recieved. I did call for a month and a half strait and did not get any return calls. Finally I spoke to the lady handling my case just to hear that the house is up for forecloser the first of september. She was not nice at all. So I'm here waiting for a loan modification package to come. Been waiting the whole week!

LOAN
OUR LOAN IS NOW BEING SERVICED WITH OCWEN (PREVIOUS'LY WITH TAYLOR BEAN/SPARTA). WE MODIFIED OUR LOAN IN MAY, MADE ALL OF THE PAYMENTS ON TIME, AND OCWEN SAYS "WE MIGHT HONOR YOUR MODIFICATION", "IN THE MEAN TIME YOUR LOAN IS IN FORCLOSURE! wHAT ARE WE SUPPOSED TO DO? WE HAD NO IDEA TAYLOR BEAN WOULD DO THIS TO THEIR CUSTOMERS...THEY HAVE TAKEN US FROM BAD TO WORSE! I CAN'T GET ANYONE FROM TAYLOR BEAN/ SPARA TO RESPOND, AND OCWEN WON'T ANSWER OUR QUESTIONS EITHER!

Awful company
I am reporting Ocwen for not having good business practices and having me sign a document fraudulently. We have owned our house for just under three years and have had nothing but problems with Ocwen. We have escrow included in our mortgage payment every month. We were actually paying extra when we first got the loan to try and make our principle go down quicker. Unfortunately Ocwen did not apply the additional to the principle but instead applied it wherever they wanted. Our Home Owner's Insurance went up after a big storm so they raised our escrow...we paid more each month to cover this. However we get a letter saying that our escrow is short. We end up paying extra to make sure that it is brought current and everything seems fine. In January of this year we get a letter stating that we are being offered a modification to our loan to cover a shortage in our escrow of $900.00. We are concerned and call them and ask how this is possible. We were advised that it was possible because our taxes went up...ok so our options are...sign the modification or send them and extra $900.00

The problem that I have is that I work for a mortgage company and have dealt with modifications before. The agreement they sent us was date 1/13/09 and was received on 1/23/09. We had until 1/28/09 to return the signed document agreeing to the modification of lowering our interest rate a little and lowering the payment a little to make up the difference in the escrow over the next three years. My concern was that the modification was to go into affect on 1/1/09 but I received the document on 1/23/09 and had already made my January payment more than what was stated in the modification agreement. I called and advised them that their agreement was not correct in that I could not sign something agreeing to something in the past as that would mean I had already breached the agreement by making a different payment amount than I should have. I advised that the agreement should be effective 2/1/09 and not 1/1/09. They advised that they had sent out a bunch of these letters and that I was the first person to voice concern. They advised that they would correct it and send me a new document...Remember it is in Ocwen's best interest to do this because they can earn a higher interest for the Month of January by correcting the document.

The other issue with the document was that it said my payment amount would only be $xx.xx (the principle and interest portion only with no escrow included.) It did not reference what my total payment each month should be including principle, interest, and ESCROW. Therefore I could send in my payment and still be behind if I was not aware of this since it was not spelled out in the letter. Luckily from my work experience I knew this amount could not be correct and continued to send the amount I had been paying for the past three years.

I never received the document of course. I called back on January 28th and advised them that I was concerned that it had to be returned that day and that I hadn't go the corrected on after being promised it for 5 days. They advised they could not correct it because once a modification is offered it can not be offered again or modified in any way, which I know is false because the company I work for does this all the time for people to actually work with them.

They advised that my only option was to either sign the document or send them the $900.00 and continue to pay the higher interest rate. I decided to sign the document, even though I legally should not have. I had the document notarized showing the date that it was signed and also sent a letter to them again voicing my concerns of the document that they were forcing me to sign fraudulently since I had no other option and no time for an attorney to get involved.

Of course I have heard nothing in regards to my concerns voiced in the letter. We are hoping to be able to refinance with a different company soon to be able to not have to deal with Ocwen ever again.
