November of 2008 There was a charge made on my ATM at an Arco gas station at 5am that made me go over (negative), but my card was in my wallet and my pin # was used. I went to a BofA branch, my card was cut up and a new one given to me and all the charges were reversed while they did their investigation. A few weeks later bank of america check card fraud said that my claim was denied because my pin and card were used to make the transaction therefore it was valid use of my atm card.
