My father passed away with quite a few debts and very little assets. His estate was insolvent and under Washington State estate laws, you can file for probate and what is left of the estate liabilities is given in the order of precendence 1) estate administration (filing fees, attorney fees, etc.) 2) funeral expenses 3) medical expenses of last illnesses...and so forth.
