Overdraft fees THEFT!
Bank of America Steals your money by using Overdraft fees! They look at a large amount rather then a small amount over a date that was used by debit card transactions. The bank online kept reshuffle my checking account balance online. I was very careful with my check book balance and post down what I used with my debit card. On Sunday, I had a positive balance and made a cash withdrawal, then on Monday there was an electronic withdrawal from a car insurance. They change me 4 overdraft fees because I made two small amount of gas station transaction a week before. It shows cleared online. They charge me for withdrawal cash even though I had a positive balance. wtf is that?!?! BOA is RIP OFF!!! I'm going to close my bank account soon as possible. Another thing I wanted to transfer funds to a different bank, unfortunately they wont let me because I must open savings account! Huh? I don't want no savings account with BOA! They want to control the customers! What a greedy bank! I'm so unhappy with their service! They SUCKY!!!

Claims Department
The so-called "Claims Department" at Bank of America is a complete joke. After I filed a checkcard purchase dispute, they sent me a letter with a copy of the transaction from the credit card terminal stating that the charge was legitimate (which it was not). So, I did the investigative work on my own-wasting several hours on the phone and doing follow up. Their investigators did not make 1 phone call into the company to see about the charge-not 1. This was a complete pain and yet again, another example of Bank of America's lack of professionalism and customer service. After all that work, they still charged me overdraft fees and closed the claim without waiting for the proof of receipt/refund/admit of error from the company who charged my card in error. Don't even bother contacting these customer service people-they don't make note and or extend any customer service.

loan modification
I have been a loan client of Bank of America since 2008 after they absorbed my original loan company, Countrywide Mortgage that my mortgage was with since 2001. I have always had an impeccable payment record and never missed a payment. Since the housing market crisis last year, and as has been the case with many others caught in it, the mortgage on my home has surpassed its current market assessed value.
As a single income mother with 2 young daughters, and due to the loss of child support income, I proactively sought your assistance and applied for a loan modification with Bank of America at the beginning of this year. I had submitted my original application on January 27th, 2010 but sent my February mortgage payment in full which was received on February 5th, 2010. It was not posted until February 19th, however, which apparently made me delinquent. The cancelled check does show it was received the first week of the month, but it was placed in a forbearance account and not entered into the record.
I was informed that I pre-qualified for a loan modification and was placed on a trial plan for a three month period. I went ahead and paid the modified trial payments of 1208.37 for the months of March and April. Not having heard anything about the status of the modification, I contacted your institution on April 15th to inquire. It was at this point I was informed that the application had been denied the previous day, April 14th stating I was not in imminent default. I never received a denial letter and I was advised that, despite all the money sent in during the trial period having been received, my account was now showing as severely delinquent.
I was then told that I would be referred to a different department of Bank of America who would see if I qualified for an alternative program. I was to receive an application packet within 2 weeks. Nothing was ever received. I recontacted Bank of America again and was told that I would receive something within 10 days that the bank was backlogged with applications and they would send it out.
Again, nothing was received.
When I called back, I was now informed that, due to the loss of child support not being considered a qualifying hardship, the timeframe to work out an alternative solution had expired and I was in arrears in the amount of $3800 which would be required immediately to bring the account current. Not to mention I was told to “try to make it a year in the house and I could apply for a mod again at that time”.
I explained that I could not afford this amount which was the reason I attempted to be proactive and contacted you at the beginning of the year in the first place.
Instead of working with my situation, I feel I was set up to fail just so your company could foreclose on my property despite all my attempts at wishing to work out an amicable solution. I now have to move my self and my kids all because I attempted to proactively save my house but you didn’t feel I was at risk of hardship nor did you feel my loan was worth modifying to keep my family in our home.
I don’t understand why the trial payments were good enough for the trial period which was put in place to see if I could make the payments, which I could in a timely manner yet I was still denied. Why set up the trial period payments with a borrower if you are just going to deny them at the end of the period. That’s what the program was intended for correct?
The making home affordable plan was designed to help homeowners keep their homes. I also understand that the government helps the mortgage companies who help their clients. I have been making this mortgage payment for over 10 years without 1 late payment ever and when I needed the help you were not there to assist me.
When you have a borrower able to make those trial payments and fulfill the loan obligations on the property it makes no sense that you would deny them and take on a foreclosure. When I entered into this I was not delinquent, my loan was paid on time every month. Once entered into the program I was then delinquent and denied. The modification states that once the trial payments are made that the loan would be modified and the payments would continue at the rate the trial payment was set at, not to mention if your mortgage was over 31 percent of your income you were eligible and my income is 52 percent of my income yet I was denied. I do not understand the practice here.
I will let people know of my experience with your bank not that it will make a difference to your institution but other people need to be aware that you do not help those that actually need it. We will be moving but I just wanted you to know this was one home you could’ve helped save from foreclosure.

Bad service
Two years I asked for help! Mainly just to stop paying my principal so I had money to pay my credit cards off. I made 1st payment on property taxes in 09 but fell behind. I was able to catch back up in 2010 and made 1st payment again. In March I get a notice that BoA paided off 09 taxes without telling me and then they escrowed the next two years taxes into my loan which took my loan from $800 to either $1205-$1600 depending on how I wanted to pay them back. Hello I needed it to go down no double in price. Once again I started calling to see whats going on and try and get tempary help. Guess what they told me EVERY TIME?? That because I wasnt DELIQUENT they couldnt do anything to help(also income). So I took their advise and stopped paying my loan. Shortly after the first missed payment my phone started blowing up!! Two days after they didnt get the 2nd payment they send me a letter (NOTICE OF INTENT TO ACCELERATE) meaning that I better pay of they will foreclouse! Now this is after only 1.5 months they start threating to take my home. When I own 50% of the property. After receieving this letter I call finally to talk and see if their able to help. Well finally after getting someone the spoke english the first words out of their mouth were are you making a payment. No remorse to try and find out if they could help me. I've never felt so walked on in my life. This coming from someone whos been robbed by family, cheated on by friends and loved ones and just plain chewed up and spit out by others!! PLEASE TAKE MY ADVISE AND THAT THESE PEOPLE DONT CARE ABOUT ANYTHING BUT THERE BOTTOM LINE. REMIND THESE'S COMPANIES THAT IF IT WASNT FOR US THEY WOULD HAVE NO BOTTOM LINE SINCE WE HELP THEM GET THREW THOUGH TIMES BUT THEY WONT RETURN THE FAVOR!! HOPE THIS HELPS ANYONE FROM MAKING THE WRONG CHOICE!!

OVER DRAFT FEES
So how about these cheap skates bank of america?? I check my online banking on a daily basis... a pending trasaction had yet to post, I was showing in my account a little more than I had but since I had just checked it I figured it was ok to get my coffee. Get to work and check my account again and nothing has posted yet so I figured I'd wait till lunch to put the money in my account. For what ever reason didn't deposit on lunch and all day the bank account online reads clear and good and shows the cofffee this morning. Long story short well after 5pm my account still red more than positive so I figured I'd wait and go to the bank the next day. Well guess what ??? BANK OF AMERICA pulls its pending transactions at the end of the day(11:59) instead of the begining for the sole purpose of maximizing the potential for overdraft fees. SO sure enough after all night of my account reading in the positive... when I awoke the next day I saw my account now read in the negative I went on the way to work and deposited cash into my account and more than cleared it up.. when I talk to the bank they told me I didn't put the money in on time.. "I would have avoided the fee if I had deposited the money on the same business day"!!! which is impossible because as BofA clearified with me they pull all pending transactions at 11:59pm giving 1 minute to get to an atm yet atm's that take cash say on them anything after 8pm will be posted as the next business day.. so guess what $35 fee... no way out of it... they wished there was something they could do
bank of america is slowly gobbling up all the banks that once actually cared about the "individual" their percentage of interest on their bank accounts are .5% or their high yeliding cd's 1.75%.. give me a break and they pay their shareholders 1 penny per dividend... how pathetic..
because they are becoming so big they do not care any more.. in their board meetings they must be laughing asking what can we take from them next?? don't even get me started on all the money they got from the bail out BS*@!! and they still treat their shareholders and their back bone the people paying all the bills... THEIR CUSTOMERS>>>US like a little kids piggy bank wondering what they can take from us next.
I suggest banking locally if you can...it may be an extra few minutes in your day but if this keeps going this way I'm afraid of whats next.. aren't you?

Late Charges and Interest on staemtents not received
I have held this credit card account since 2004 with the same address. I pay the balance due IN
FULL every month. Approximately six months ago, just after the new regulations went into effect,
I began to have issues with getting my statement. I noted that I had not received a statement and
called their toll free customer service number. Upon verifying my address, I found that after 6
years of using that same address, they had somehow mysteriously had it wrong in their system.
As the bill was not due at that time, I had them correct the address, requested a copy of the
statement and the amount due, went to the bank and paid it IN FULL. The next few statements
arrived and were paid IN FULL. Last month, 5/2010, I received a call from a B of A representative,
two days after the March bill was due, informing me that both the February and March bills had
gone unpaid. Upon verifying my address, it was determined that B of A, once again, my address
in their system had mysteriously been altered. The representative, once again, corrected the
address, credited me for late charges in the amount of $78 for the 2 months, although, I don't
know if interest charges were credited because I have not received another statement since then.
I did, however, receive the two statements "ACCOMPANIED BY A LETTER STATING THAT
THEY WERE PROVIDED EITHER AT MY REQUEST OR BECAUSE STATEMENTS HAD BEEN
DAMAGED DURING THEIR PRINTING PROCESS" for February and March at that same address,
several days later. No mention was made of THEIR error. I have not received a statement since
then. This morning, realizing that I had not received a statement again, I called B of A "customer
service" and was told they had the right address and that my statements had been mailed, and
once again, the payment was overdue, but they could/would not reverse any late charges. They
suggested I contact the post office, but I have absolutely never had any problem receiving any

credit card statements or other mail at that address, and B of A has screwed it up 3 times in six
months, so arguably there is something wrong there. I asked for a supervisor and spoke with a
misty who basically repeated the same thing again. When I told her I wanted to speak with a
superior she said she could have someone call me back within 3 days. When I asked her for
some means of identifying her, she replied that none was available except her name was "Misty",
no transaction, id, last name or other means was to be provided to me. When I asked for a
dispute form, she stated that it was on the back of the statement (which I hadn't received) and
said I "couldn't dispute a late charge" using that form. When I asked how to dispute one, she said
"with me". After that it all gets rather circular. I find it highly suspicious that, as soon as the new
credit card rules became mandatory, all of a sudden billing addresses have been mysteriously
altered. Oddly, I regularly receive junk mail from B of A a that address with no problem. I also find
it highly suspicious that the only statement that has this difficulty is the one that gets PAID IN
FULL, every month. It's the banks position that I should pay my bill regardless of any demand for
payment, although my agreement with them clearly states that "charges will be billed". Because
the bank representative informed me that I have no recourse, refuses to identify anyone in
authority to deal with or provide any verification that they have mailed the statements, I will be
consulting with an attorney experienced in class action litigation with financial institutions to
determine if there is a pattern of this kind of conduct and a certifiable class. It seems to me just
another way for the institution to make money from people who manage their credit responsibly.

Cusotmer Service
My husband and I have (well, had) 2 accounts with Bank of America. The first had a $22, 000 credit line, and the second has a $7500 credit line. We used the card with the larger credit line to waterproof our basement 3 years ago. We were offered 0% interest for 15 months. We paid that account off and have not used it since. Our other card has approx $5500 on it due to my husbands unemployment last year. We have always paid more than the minimum and have never been 1 day late with any payments. I actually intentionally pay it early. In February 2010, I called to make sure that our card with the $22, 000 credit line was ok, as we are adoptiong a child and that was the exact amount of money that we needed...we did not want to take out a loan. The rep stated that all was well and the card was available with a $22, 000 limit. As we were going through our adoption process, we received a letter from Bank of America not less than 2 weeks later stating that they have closed our card because we have too much debt (we make a combined salary of $100, 000 per year, and have no car loans, and no debt other than our other BOA credit card, a Lowes card which has $900 0n it, and a Chase credit card that has $2600 on it). Funny when we opened our BOA card we had over $30, 000 in debt and my husband made half of what he makes now..but we were still approved. So whatever..they closed our card. We called customer service but they refused to do anything. I guess another bank wants our $22, 000 in business. I called BOA last week to find out if they could lower the interest rate on our other card. They refused and told us we should contact someone in their credit counseling division???? For what..we don't need credit counseling, we need our interest rate lowered. Gave that a shot and got a lecture about using credit responsibly. After that phone call, I was emailed a survey about my experience. Of course, I was not very nice. I then received an email yesterday that our other card's limit was reduced for the same reason they closed our last account. We have approx $5500 on that card and they lowered the limit to $5600. I beat them at their own game and called up our trusty Discover card (which we have no balance on). They were able to increase our credit line, and gave us 1.9% for the next 12 months on balance transfers. I guess they need the business, or are more willing to help their good customers. I have since closed my other BOA credit card and refuse to do business with them in the future. Beyond our few small cards that we will be paying off this year, we will be using nothing but cash. The experience with BOA has proven to me that the banks do not deserve our hard earned money...oh wait, we already gave them our hard earned money when we all BAILED BANK OF AMERICA OUT OF THE HOLE THEY PUT THEMSELVES IN WITH BAD MORTGAGES. PERHAPS THEY SHOULD FOCUS MORE ON THE PEOPLE WHO ARE NOT PAYING THEIR BILLS AND LAY OFF OF THE ONES WHO ARE. SHAME ON THEM FOR MISTREATING THEIR CUSTOMERS.

Short Sale/Unprofessional business practices
I have been trying to complete a short sale with Bank of America for a year and a half quite unsuccessfully. Bank of America has repetedly lost correspondence and information that my real estate agent and myself have submitted. Neither their short sale department, forclosure department or their collections department are in communication with eachother and have had to deal with all three departments. At no time was information in collections retained for further calls and I recieve on average 5 calls per day beginning at 7:00 a.m. and ending around 9:00 p.m. I spoke with a membe3r of the modification department earlier today and this man was incredibly rude and condescending and refused to give me his name on several requests. The only time we were close to closing, Bank of America put the wrong names on the paperwork and 3 1/2 weeks later have still not corrected the matter. During this time, they insisted I resend the original letter of hardship and wanted to completely restart the process because they had passed over some time period restraint. This situation has not yet been resolved.

Mortgage Modification Program
Bank of America holds my mortgage. I inquired about the mortgage modification program on Bank of America's website in October 2009. I heard nothing until January 2010 when I received a FedEx package requesting information. It gave me only a few days to send the information back, and since I didn't have the time to collect the infomation, I decided not to persue it any further. Two weeks later I received another package similar to the first one asking for information. This time I collected the information and FedEx'd it back to Bank of America. I heard nothing for the next 6 weeks. In the meantime, I continued to get FedEx packages from Bank of America asking for the same information I already sent them. Then, my husband receives a call from Bank of America asking if we are going to pursue the Mortgage Modification Process. He told him no since they obviously don't know what they are doing. Finally, in April, I find out that not only am I in a trial period for the Mortgage Modification Program (and had been since February), they had me as past due since the trial period amount was MORE than my monthly mortgage payment. I called Bank of America and told them that my husband spoke with someone and told them we were not going forward with the process, especially when they kept sending us the same request for information that we already sent them back in January. I was told I needed to send a letter opting out of the program. Once I did that, everything would be fixed. I sent the letter on April 30. I called Bank of America on May 4 and they confirmed receipt of the letter and told me I would be removed from the program within 10-15 day. As of today (June 24), I am still in the program. I have even gone so far as to go into one of their local branches to have an actual person that I can see help me. Even these poor employees seem to be getting nowhere with the Mortgage Modification Department. I am afraid that my perfect credit score is ruined because of this mess. My next step is to file a complaint with the Illinois Attorney General regarding this. I will never, ever do business again with Bank of America once this fiasco is over. I wish I never heard about the Mortgage Modification Program.

B of A has been negligent to their customers
B of A has been negligent to their customers. I have waited since May 7 to have repairs done on my home which occurred on March 21 and here it is June 9. Each time I contact B/A's associates I given different stories. It is a learned environment for lying. I have contact BBB, FTC and my congresswoman.
