Lied about Modification
Five years ago we put $80, 000 down on a home in Flowery Branch Ga. We always made our payments but then my husband was laid of and we applied for the "Obama" plan. Bank of America sent us papers and I filled out everything that was needed, I never had a clue that my home was being foreclosed on. They made us believe that everything was fine. Then on the 28th of July I got a paper in the mail stating that my home was in the fore-closer process. I tried to call but the said it was fine, "computer generated" and not to worry that I had until the 18th of Aug. to get the paper work that they needed in. They sold my home on the 2nd of Aug. I have four children and had no place to go... They stole $80, 000 from me and my family. What should I do???? Please help me! Michelle Vansickle 6788876928

Loan modificaiton scam
I was enrolled in Obama’s Home Affordable modification program through BOA in Jan 2010. BOA put un into HAMP trial payment plan. Soon after the 3 months of trial was over I kept calling BOA and they asked me to continue making trial payments since my case was still under review.
In Jul 2010 they rejected my mortgage application saying that I have missing documents. I had sent them the set of documents for about 2-3 times. I appealed their decision and my case was re-opened. Again I was asked to continue making trial payments. In the mean time I started getting letters of accelerate to foreclosure and collection calls. I called BOA loan modification department and they asked me to ignore the letters and continue making trial payments. I received foreclosure notice last week. I was really scared and surprised. When I called BOA about it, within 3 days they rejected my loan modification application which was pending for 10 months.
All these time, I have been paying trial payments and have never missed even a single payment. Boa reported to credit companies as a delinquency and now my credit score is down from 790 to 660. I feel I am been screwed. They want all the money in next 2 weeks now. I don’t know what to do. They are going to foreclose my house.
I want to retain this house and don't want to let it go to foreclosure or short sale.

Loan Modification
Back in November I went to Bof A to request a loan modification I was declined, I had lost my job and just got a new one, I was delined because I made all of my payments on time. I was told by the agent to stop making my payments and I would receive help. Sure enough, I decided to do this after I depleted my savings.
2 months after missing payments I get an envelope from bofa saying I may qualify for a modification. great. at the time I had a credit score of 800. Okay first they say I am missing information they were kind enough to send me a fed x envelope with a pre paid fedX envelope. I got together all my paperwork and fedX it to the address that was printed on the package. They claimed they never recieved it. I was once again sent an envelope I quickly went out and recopied all my information 45 pages of my life Fed X again. Well guess what they lost that one too. I quickly clled them quite upset demanding to talk to an underwriter. I spoke to someone named Sunny. She was helpful and gave me a fax number to send thsi information to her . great I was told to go down to any Bank of america to fax it in. Bof A could not get it faxed. The following day I called Sunny the underwriter back and she wasn't available I talked to someone else who said that fax number did not exsist. So they gave me 2 other fax numbers. I went back to bank of america and they kindly faxed over to both numbers and gave me receipts showing the fax went thru. I called Sunny to see if she recieved it and she said no, but guess waht she was transferring and someone else is getting my file. okay this is now September. I have been making loan modification payments everymonth. I called back and I was told Yes we have your paperwork. I called every month and it was in process. October 28th I called to make my monthly loan modification and was told that the decison was made I WAS DECLINED!!! I ask them why, he said I would recieve a letter in by fed X. Sure enough I get a letter today saying I was declined "FOR FAILURE TO SUBMIT ALL PROPER DOCUMENTS"

Fraudulent Fee
My Bank of America credit card charged my checking account twice with its autopay feature in September. The second time it overdrew my checking account. Once I discovered what happened, I contacted B of A and they admitted their error and refunded the second withdrawal back to my checking account, though it did take about two weeks to see the money in my account again. Soon after I found a "return check fee" in the amount of $25 for the second withdrawal that overdrew my account, not from my checking account's bank, but from B of A on my credit card. Again, I explained the situation and they reversed that charge.
Then, a month after all this, I get a "cash advance interest fee" for the refund they gave me in the amount of $90.03. I told them of their error, the confusion, to multiple people, and they absolutely believe they're in the right and it's a legitimate charge. I have nobody to turn to because normally when I get hit with a fraudulent charge, the credit card company covers it.

ONLINE BANKING
My online banking name is reporting as my ex-husbands name and bank of america also approved him a $43k truck loan on my previously paid boat loan, obtained as a single person in my name only. When we were married I was added to his bank account, however my boat loan stayed in my name only and was paid off in 2005. Come to find out now that my mortgage loan has been sold to BOA, I try to set up my online banking account only to find I'm listed as a co-owner on a $43k loan for a truck my ex-husband got after we were divorced and our accounts are all the sudden consolidated. No paperwork, no acknowlegement and no signature!
I would have never found out I was listed as a co-owner had I not registered my mortgage loan for online banking. Needless to say, after 8 phone calls, numerous passing the buck from online banking to mortgage, back to online banking to technical assistance, back to mortage and online banking again, I got a rep who slipped up and told me the original rep had consolidated our accounts and oops, he also got approved on my previously paid off bank of america boat loan for his new truck. Just happens during the 4+ years I haven't been a BOA customer (THANK GOD I HAD 4+ STRESS FREE YEARS UNTIL NOW) BOA has gone through many software and programming changes and evidently our accounts, even though we provided BOA forms and divorce decree at time of divorce in early 2006 to remove me from his bank account and my boat loan was paid off and never shown to be consolidated with his name or a revolving line of credit. Now all the sudden, conviently, my paid off boat loan is a revolving line of credit and BOA is blaming the programming for consoldiating the accounts, that's the reason he was issued the credit.
My ex-husband and I parted on good terms and he is now refinancing his vehicle loan to get it out of my name. BOA wants me to bring paperwork showing my name change after 2006 in order to remove him from the mortgage and restore my maiden name which the mortgage was taken out in. Funny thing, I have no paperwork after 2006 showing a name change, because there wasn't one! BOA is the one that just consoldiated the accounts miraciously and changed my name.
Only thing BOA has done is make it where I can't see my ex-husbands line of credit account(my previous paid off boat installment loan) and he cannot see my mortgage. However the issues are still unresolved! I'm a co-owner on a loan I never signed for, my mortgage is showing in my ex-husbands name. Why am I having to provide paperwork and time and effort working to clear up something BOA screwed up on it's own.
I have posted this on my Facebook page for everyone to see. Not to mention I plan to tell EVERYONE I know not to trust BOA and also goto the local networks as well as newspapers, major networks and seek an attorney.
I'm sure there is an attorney out there somewhere that would be hungry enough to take on a banking giant, that has outgrown their pants and refuses to give customer service, when that attorney might get his portion of a multi-million dollar settlement for defrauding customers and violating their rights and issuing credit to customers illegally!
It's on like Donkey Kong Bank of America. I may be one woman, but here me roar I have a huge mouth and plan to make sure I'm heard in every square mile of the earth. It ain't over, til it's over!
BANK OF AMERICA NEEDS TO WAKE UP!! MANAGEMENT AND CUSTOMER SERVICE NEED TO LEARN HOW TO TAKE OWNERSHIP OF PROBLEMS THEY CREATED!

loan modification
I have been working with Bank of America for 18 months on loan modification. First of all, they wouldn't even talk to me unless I was behind. I was forced to play their game. I paid them "trial" payments for 11 months, all before they were even due. I finally get a modification package which noone has been able to talk to me about. I was told that was their offer and it was not negotiable. The only thing they addressed was the payment. The principle went up $10, 000.00 and I had a balloon payment at the end of $18, 000.00 The house is barely worth 1/2 of the loan amount and they payment they figured out is still close to50% of my takehome. Hesitantly, I agreed to all their rediculous terms. I figured all that matters was that I could afford the payment and stay in my home. Eventually, the value of the house has to go up again. I started their new increased payments although I never got confirmation from them that they recieved my signed packet back. Here's where I lost it...after making 2 new payments, I get a letter saying I am one month behind. After talking to them, they tell me they applied my first new payment to the principle and if I don't send another payment, I will always be one month behind accruing late fees and hurting my credit. 2 payments is impossible for me to send. For over a year, I wonder...am I keeping this house or loosing it? I'm mentally drained, depressed often and have totally given up complying with their every request. For peace of mind I am ready to let them just take the house back. I can live just as well anywhere else and pay 1/2 what I'm paying here. Time to downsize, live within my means and get some peace into my life. I'm not the first, nor will I be the last to loose in such a big investment. My only regret is that I may not ever save enough for another down on a house and that my kids and grandchildren will not have a place to call their own. God knows I did my best. I'm turning in my keys...

High Interest Rate
I have paid more than the minimum monthly payment and on time. My interest rate went from 7.99 to 13.99 to 19.99.
I have called Bank of America to ask to lower my interest rate since my financial circumstances have changed since I opened the card. Each time I have been refused.
Those who pay in a timely manner are penalized for those who have stopped paying on their cards.
I vaguely remember that BOA had a television commercial saying they would help those who were having financial difficulties because of the economy. I must have been dreaming.

Rip Off and Poor Service
COMPLAINT - MARY MCCOY - SMALL BUSINESS Escalation Supervisor...- Worst service provided by her...
- This must be the 5th or 6th time I called to discontinue online Invoicing and direct payment service..
- BOA had been charging me 20 bucks every month every time I was told that they have opened a service request and someone would get back with the answer/resolution...
Finally talked to Mary McCoy: (Supervisor Small business escalation department - supposedly highest rank I could talk to...)
- She says that she is highest in the ranks - can only go give $40 back..
- She says there is no other process for getting refund for inappropriately charged amount...
- She says that people who have told me have lied and she is the ultimate authority for BOA...
I am extremely disappointed to get such a response... and top of that she decides to hang the phone up declining to transfer the phone to her supervisor when asked multiple times...
I have to agree that BOA does have policies that are designed to rip customers off... and the attitude is a dont care attitude...
