Credit report
This is the letter I FAXED to BOA today. I still find it hard to believe what they've done to me and my credit score...for no reason that I can think of...
should I seek legal damages? I'm sure I would lose. With the cancer and treatement side effects I don't have much energy. I guess I was naive...
I am writing you today to express my extreme disappointment (and disbelief) about how I’ve been treated by BOA. Prior to my finding out recently that I was reported by BOA to all 3 credit agencies that I was 90 days late on my mortgage loan I thought BOA was a caring bank.
The reason I thought this is because last September 2009 I was diagnosed with a rare type of cancer. I immediately started undergoing daily high radiation treatments. By November 2009 I was so sick that I could not swallow and had difficulty talking. I had to have a feeding tube surgically placed into my stomach to receive nutrition because I was unable to swallow. During this terrible period I called BOA (with much difficulty talking) to ask if they had any special programs or options to assist someone like me – a good customer that expected to be back to work etc in just a few months but would appreciate a break with house payments for 2-4 months since I was unable to work and was feeling very stressed about my finances. I was told by a helpful BOA rep. that I could receive a special forbearance agreement and my monthly mortgage payments would be suspended for 3 months (interest etc would continue to accrue). When I heard this I was thrilled because, while I could and would continue making my payments on time every month as I had for the previous 9 years, a 3 month break would relieve some of my financial stress. I was so happy and pleased that BOA had this program to help people undergoing an unusual and temporary situational stress. I soon received a contract that stated I would not need to make payments for Dec., Jan and Feb. (12/2009 – 2/2010). I was very happy.
I was BOA’s biggest fan at that point. Suspending my payments for 3 months while I was receiving chemotherapy. WOW, a big bank actually caring that I was sick and giving me a break for a few months. I told many friends and family how helpful BOA was.
I received the contract, reviewed it quickly (as I was extremely ill and thought I could trust BOA) and returned it.
I guess I was painfully naive or just plain stupid.
Shortly after my cancer treatment ended I returned to work and tried to get on with my life. I did sell my home (that was financed by BOA) in March 2010.
I recently discovered that the 3 months of suspended loan payments was reported by BOA to credit agencies as me being 3 months late on my payments!!! This report has ruined my credit. I contacted BOA thinking this was some kind of error. They now tell me that it is stated in the contract I signed that while they were suspending my payments for 3 months they were still going to report me as late to credit agencies. I am in disbelief. Why would they do this to me? What do they have to gain? What purpose does this serve to BOA or anyone? If I had realized that this was their plan (to give me 3 months of suspended benefits but reporting me 3 months behind on payments) I would NEVER have signed the document and would have found a way to make my payments on time every month as I had for the past 9 years. So now I’m going to suffer for years because BOA wants to kick me while I’m down???
For the life of me I just can’t understand what their purpose is.
Why won’t they take this off my credit report???? Yes, I signed this contact…..yes; I did not understand this point in the contract….but again…why??? Is it punishment for being sick and asking for some help?

WHY???? Punishment for asking for and receiving help?? There is NO OTHER REASON!!!

Home Mortgage
On May 17 I contracted to sell my house in North Carolina to a buyer who was prequalified by BofA on May 14. The house was supposed to close on July 16 to provide the buyer ample time for meeting the requirements of a VA loan. All appraisals were conducted and I was told they were better than anticipated, being above the contracted price. I was assured by my real estate agent who spoke with BofA that the loan "was fine" prior to moving from the home so that the buyer could take possession on the day of closing.
On July 15, my realtor informed me that the deal was not closing because BofA had not processed the loan. She was told by BofA that the bank decided to close all of the "government rebate" mortgages first, but that my buyer's loan would go to the top as soon as those loans were finished.
The following week, I was told that the loan was held up once again because the buyer needed to provide proof of child support and that she did the day it was requested. We set another closing date.
That date came and another excuse from BofA - something about everyone in the Jacksonville office walking out and more documents still being needed from the buyer. Once again we were assured that "everything was fine." Once again we set a closing date - today at 7:30 AM EDT.
Once again, no closing. This time I was assured that the underwriter has the loan, but no one call tell me or the buyer what is going on and when or if the house will go to closing. The constantly shifting explanations for the delays and the inability or unwillingness of BofA to expedite and finalize this loan are causing me emotional distress and are costing me money.
Had I know that this company was going to so mishandle this loan, I never would have contracted for this sale. While I do not expect that BofA will approve every loan for every buyer, I do expect that prequalification means more than BofA will accept an application. I also do not expect BofA, or any other bank for that matter, to take almost three months to approve a loan or close on a house. Most importantly, I do not expect BofA to continually fabricate excuses to explain what I can only conclude at this point is incompetence or negligence in processing this loan application. My conclusion is thus that BofA treats its customers with such disrespect because it is not only “Too Big to Fail, ” but it is also “Too Big to Give a Damn.”
As of today, I have paid 20 days of interest, taxes, and insurance that I should not have had to pay. With no closing date, I face the possibility of having to put the house back on the market. Since I have moved to my new home, putting my house back on the market will mean an unknown amount of additional monies for principal, interest, taxes, and insurance.

NSF/ Holds
I have been with BofA for approx 2 months, I have made weekly deposits from the same issuer and in the same amount. The deposited checks have never bounced and are from a local business bank. BofA places holds on my check every week for three business day which happenes to close at 5pm. This practice has caused me to have checks returned because of this hold. I call BofA and spoke with Michelle from costomer solutions, who could not explain why a hold was placed every week. I asked for the hold to be remove so I could access my founds. Of course she was a robot and could not think outside the box. I feel they place holds on checks in an attempt to get over draft fees. I would shop around before banking here at B of A.

Online Bill Pay
I have been using online Bill Pay through my personal BofA account for at least seven years. Last month, I paid two of my credit card bills online and somehow that information was lost from their system. Fast forward to this month, I receive my statements showing late fees and interest charges that should not have been. I called BofA and they informed me they had no record of the transaction (naturally) and suggested I write down the confirmation numbers presented when submitting online bill payments. Lesson learned for me. I have to believe that there was some internal system issue that lost my data, and am posting this to see if others have ever experienced this issue. I have never had this issue before, pay all my bills on line each month--- just seems very suspicious that two bills I submitted for payment in the same session were not paid. I do agree that it could have been user error (me) but think it was pretty unlikely given my experience in using the UI.
Has anyone experienced a similar issue?

NSF fees
Bank of America reset my account to accept all transactions pending the law changes next week. I did 7 transactions all small when I thought my card should have declined if it was empty it APPROVED all of them, now they charged me 7 NSF fees of $35.00 each, I talked to management they said ALL ACCOUNTS were reset as the law would be changing AUGUST 1st and people had to opt in to not have the fees anymore. You think you have your account set, but this bank with Deep pockets just wants to take what they can until the law passes. They have no compassion, they even admitted it was changed, NOT BY ME, , , , they decided to line there cheating pockets before they lost income from broke people. WATCH out if you bank there they are HORRIBLE>

Check Cashing Fee
My 16 year old son got his first job and was paid via a check written on a Bank of America account. He went into branch and was charged $6 to cash a check written on BofA's own bank!
Talk about gouging! The bank took no risk on cashing the check because they knew the account had funds in it. It was written on their own account holder! Then to charge what amounted to a 12% interest to cash their own check!
Explanation given was that this was "their policy". Secondly, they didn't look at his age. I pointed out they sure looked at his ID and fingerprint! What scumbags!
How do they sleep at night?

corrupt, lying agents, fraudulent charges
Bank of America bought my escrow company. The beginning of my nightmare. They doubled my escrow payment for no reason. They then applied my principal/interest payment to that fraudulent charge. I immediatly got the escrow department to reverse that payment amount because there was no reason for it. The bank, for eight months so far, has been adding late fees for the misapplying of my contractually obligated payment to the escrow which I can, and will, cancel at any time. I have been through a dozen customer service agt who can not help me, but whose job it is to shut me up and get me off the phone. After a few months i just demand a supervisor. I have been hung up on when I ask for one. I was told by one that they reapplied the payment and the problem was fixed, but they cannot waivve all the late fees. I got a supervisor who did not have the power to waive but one late fee, when there were months of them. She spent a month and waived all the fees. but the fees kept being applied. She refused to waive more, because the misapplied payment, from months ago was still misapplied and showing each month late. She referred me to a different department and that person claimed they fixed it and waived the late fees. yet i am still getting late fees. and i am unable to get through to anyone but customer service agents with no power and bad attitudes.
This is all fraudulent by the bank. first doubling a payment, then taking the money from my regular, timely payment and put it on the fraudulenty doubled payment. then charging late fees every month. and NOT ONE PERSON who has power to see the problem and fix it, but everyone giving me run arounds and outright lies to shut me up and get me off the phone!

Repayment Plan
I called the Repayment Financial Hardship dept. and asked for assistance to reduce my monthly payment due to loss of income and they wanted to know my budget. All the details of my life. I found it offensive and they turned me down because I wouldn't tell them my personal expenses.
When I called Wells Fargo they dropped my interest rate more than 1/2 for 12 months until I get on my feet.
Yeah Wells Fargo!!
Who bailed the banks out--the government! Banks need to bail their customers out!

Loan Modifications and Payment Postings fraud!
Bank of America is pure evil!! They are robbing us blind stating that we owe 4 months on our mortgage when we only owe one, mainly because we had to fall behind on our payments to qualify for a loan modification. We used to have Taylor, Bean and Whitaker who went bankrupt and obviously BofA purchased their loans for pennies on the dollar. I have a PMI which guaratees these delinquents about $100, 000 from the government and alot more when they sell this house in foreclosure. Sadly, we fell into hardship when my hours were reduced at work and also the mounting expenses for our disabled son. We have been trying to modify our loan since December 2009 and they obviously are stalling and do not want to help. They will make a lot more money foreclosing on this house. I had to acquire an attorney in April due to their malicious practices and fraudulent behavior with my account. We are extremely upset and have been paying the price emotionally. My hair is falling out. My family is in turmoil because of this. My blood pressure is out of control and goes up dangerously high every time I have to speak to one of these incompetant reps that constantly lie to us. I am taking blood pressure pills everyday now because of all this distress. I am gravely depressed and obsessed with this situation. I have even had suicidal thoughts. This is truly disturbing how they can crush a family like this and cause so much pain and suffering. They have no intention in helping anyone but themselves with our tax money. I had filed a complaint with the Attorney General and he has shown interest in my case and hopefully they will investigate and prosecute to the full extent of the law Mr. Moynihan (CEO) and all of the other voltures involved in this. They need to be stopped!!!

Loan Modification
I have been working with BOA since March 2009 for a loan modification of my mortgage, since Countrywide sold my mortage to them. I have a stack of paperwork that was faxed to them over this period that would make up 2 Honolulu directory phone book. Each time I called them they passed me to a different negotiators and stated that they don't have any papers that I faxed and to faxed them again, mind you this is the 40th time faxing over the same paperwork. In December I notice that my interest statemet was way less than my 2007, only to find out my mortgage payment was put in a misc account. They claim they do that when you are waiting for a loan modification. Can you believe this $16, 000.00 of my money is a misc. account. I immediately threaten them and told them that I was going to report them to the IRS, they were collecting the interest on my money, that same day they applied the $16, 000.00 to my account. Finally in March I spoke to Robert Procell and he said well looking over our paperwork we did qualify for the Loan Modification and that he will sent the paper to us. On April I contacted him, and stated he sent my paperwork to the automated system to approve and I should have gotten the paperwork on March 17, we I still have not received. I then asked if I would also qualify for the National Home Retention Program, and he stated yes. As of today I still have not received any paperwork, every week I call BOA and again ask me to send more paperwork to them. What kind of f*&#$^% games are they playing. Finally my husband and I complained to the CEO of BOA, he then assigned another negotiator, which then passed on to another and another. Now mind you I have being doing this for over a year. Well we are now with another negotiator who is asking us for more paperwork and a monthly expense, she states list everything down, even if you purchase a stick of gum. Well I listed my cigaretts as park of entainment, she then states President Obama won't approve the cigaretts, I asked her if she spoke to him...haha. Why don't you ask him, since he is a smoker. One week later she calls and states that Making Home Affordable program would put us in paying $3900.00 a month, $1300.00 more than what I am paying. I laugh and told her for that kind of money I could live in a mansion on Hawaii's beaches. Ask them for your original deed and closing documents, they don't have it. The federal govement should shut BOA down, they are ripping everyone off, very poor customer service, rude, talk down to you. Just watch the news on the bad things that BOA is doing to everyone.
